Examination of negligence perspectives (4)
- what was the standard of care owed to the claimant by the exercise professional (was it within their scope of practice)
- did the exercise pro. breach their standard of care
- did the breach cause the harm in question
- what damages will the defandant owe to the claimant if negligence is proved
Types of negligence (4)
- inherant risks- risks that are inseparable from the activity
- ordinary negligence- failure to meet standard of care (putting them in an exercise they weren’t ready for)
- gross negligence- prior knowledge of risk but reckless (puts them in an exercise the professional knows they aren’t ready for)
- product defects/product liability- defect equipment
