pre trial Flashcards
pre trial publicity
2 types:
- factual = incriminating info
- emotional = arouse negative emotions
other info on the case can influence schemas e.g. media
- jury can create a perception of defendant before official info has been given in court
- difficult to change perceptions
competence and instructions
- jurors listen to technical info which may be far from knowledge and have to make decisions
Foster lee et al 1993 - found that giving instructions to jury member prior to presentation of technical info increased ability to focus on relevant info
Severance and Loftus 1982 - having key terms explained improved understanding of legal concepts (though not everyone demonstrated understanding). explanations assist terms jurors are familiar with but little improvement in understanding for more unfamiliar terms which results in jury members having limited comprehension on issues throughout trial
