Q: What is the law on possession with intent to supply?
S5(3) 1971 Act
it is an offence for a person to have a controlled drug in his possession, whether lawfully or not, with intent to supply it to another
Q: What if the possession is lawful?
It is irrelevant.
A doctor, vet, chemist or police officer may have lawful possession of a controlled drug, but if he attempts to unlawfully supply it to another at some point in the future then they commit this offence
Q: What are the maximum sentences for supply offences?
Class A- life imprisonment (indictment), 6 months summarily
Class B- 14 years (indictment), 6 months summarily
Class C- 14 years (indictment), 3 months summarily
Q: What is the general defence under s28 of the 1971 Act?
