Q: What are the relevant sections of the Terrorism Act 2000 relating to the financial support of terrorism?
S15-18 Terrorism Act 2000- provide offences relating to fund-raising, receiving, providing, inviting and arranging for money or other property to be made available.
In each case, intending that, or having reasonable cause to suspect that they may be used for the purposes of terrorism.
Q: 15(1), (2) and (3)?
A person commits an offence if he-
S15(1)- invites another to provide money or other property intends that it should be used, or has reasonable cause to suspect that it may be used, for the purposes of terrorism.
S15(2)- receives money or other property, and intends that it should be used, or has reasonable cause to suspect that it may be used, for the purposes of terrorism.
S15(3)- provides money or other property, and knows or has reasonable cause to suspect that it will or may be used for the purposes of terrorism
Q: s16(1) and (2)?
A person commits an offence if he-
S16(1)- uses money or other property for the purposes of terrorism.
S16(2)- possesses money or other property, and intends that it should be used, or has reasonable cause to suspect that it may be used, for the purposes of terrorism.
Q: s17 and s18?
A person commits an offence if he-
S17- enters into or becomes concerned in an arrangement as a result of which money or other property is made available or is to be made available to another, and he knows or has reasonable cause to suspect that it will or may be used for the purposes of terrorism.
S18- enters into or becomes concerned in an arrangement which facilitates the retention or control by or on behalf of another person of terrorist property by concealment, by removal from jurisdiction, by transfer to nominees, or in another way.
What is the defence to s18?
Defence to s18 (s18(2))- It is a defence for a person charged with an offence under subsection (1) to prove that he did not know and had no reasonable cause to suspect that the arrangement related to terrorist property.
Q: What is each offence punishable by?
14 years imprisonment.
Q: What is the test for ‘having reasonable cause to suspect’?
Objective test- The reference to ‘having reasonable cause to suspect that the money may be used for terrorism, does not mean that the suspect himself must actually suspect and have reasonable cause that the money may be used for terrorism, it means that from the info available to the accused a reasonable person would suspect that the money might be used for terrorism.
