Who can issue a PSO?
A constable can issue a PSO but it needs to be authorised by a qualified constable (Sergeant or above)
What is a police safety order (PSO)?
It is an order issued by a constable (on the prescribed form) to a ‘bound person’ to ensure the protection of the person at risk.
Who is the bound person?
The person against whom the order is issued.
Do police need the consent of the person at risk to issue a PSO?
No
This also avoids blame being issued at the person for police action.
Who can not have a PSO issued against them?
A person under 17 years old (does not include a married/defacto person).
When a PSO is issued what must a bound person do?
Surrounder weapons and firearms and immediately vacate the land occupied by the person at risk.
What is the duration of a PSO?
Comes into place immediately and can last up to 5 days.
