The commisioner must be informed within three days.
What is section 39 of the children, young persons, and their families act 1989?
Place of safety warrant
Allows any person authorised by warrant to enter and search any dwelling house, building, aircraft, ship, carriage, vehicle, premises of place if they believe on reasonable grounds that the CYP has suffered or is likely to suffer ill treatment serious neglect, abuse, serious deprivation or serious harm to remove or detain the child or young person (using force if necessary) and place the child or young person in the custody of the CYPS.
If the child is released before the matter coming before court, a report must be given to the commissioner for children as soon as the child is released.

Where a child or young person is found unaccompanied by a parent/guardian/other person who usually looks after them in a situation in which their physical or mental health is being or likely to be impaired a member of police may (using reasonable force) take the child or young person with their consent deliver into the custody of parent guardian other person. If no consent is given or caregivers are unwilling to take them, place the child of young person in the custody of CYFS.
They are detained under an enactment so therefore, they must be given their rights.
