What is the rule CJC 1.2 about confidence in the judiciary?
Judges must always act in a way that promotes public confidence in the independence, integrity, and impartiality of the judiciary and must avoid impropriety and the appearance of impropriety
What is the test to determine whether a judge is acting in a way that creates confidence in the judiciary?
Whether the conduct would create in reasonable minds a perception that the judge violated the CJC or did anything to reflect badly on his honesty, impartiality, temperament, or fitness to serve as a judge
What is the rule CJC 2.2 about impartiality and fairness?
A judge must uphold and apply the law and perform all duties fairly and impartially. This means he must be objective and open minded, and interpret the law without thinking about whether he approves or disapproves of it
What are the two exceptions to the CJC 2.2 about impartiality and fairness?
- Good faith errors of fact or law are OK
- Can make reasonable accommodations for pro se litigants that don’t know the legal system in order to level the playing field and ensure a fair hearing
What is the rule for pro se litigants when they file papers with the court?
They are subject to different review standards and are construed liberally in favour of the litigant
What is CJC 2.3 about bias, prejudice, and harassment?
Judge must do all of his duties without bias or prejudice and cannot engage in harassment based on race, sex, gender, religion, national origin, ethnicity, disability, age, sexual orientation, marital status, socioeconomic status, or political affiliation
What is the rule for judges regarding bias, prejudice, and harassment outside of themselves?
They also cannot allow the court staff, officials, or others under their control to harass anyone in a discriminatory fashion
What are some examples of harassment that a judge cannot engage in or allow his staff to engage in?
Epithets, slurs, demeaning nicknames, joke-based stereotypes, hostile acts, suggestions of connection between race and crime, irrelevant reference to personal characteristics. Includes facial expressions and body language
Judges must avoid impropriety and what in what areas of their lives?
The appearance of impropriety in both their personal and professional lives
What should be a judge’s goal regarding the CJC?
To exceed the standards of conduct of the rules
What is harassment?
Verbal or physical conduct denigrates or shows an aversion to anyone based on sex, race, gender, religion, national origin, ethnicity, disability, age, sexual orientation, marital status, socioeconomic status, or political affiliation
What is sexual harassment?
Sexual advances, requests for sexual favors, or verbal or physical conduct of a sexual nature that is not welcome
When must a judge disqualify himself from a proceeding?
Anytime that his impartiality might be questioned
What are some examples of times that a judge should disqualify himself from a proceeding?
If he has a personal bias against a party or an attorney, or personal knowledge of facts in the proceeding
