DC DPM Chap 16 and Article 17 of the OB.
Is the conviction of a misdemeanor cause for Discipline?
Yes; so long as it is based on conduct relevant to an employee’s position, job duties, or job activities

- Absence without official leave
- Neglect of Duty
- Insubordination
- Incompetence
- Misfeasance (legal act but performed improperly)
- Malfeasance (an illegal act)
- unreasonable failure to assist a fellow gov. employee in carrying out assigned duties
- Unreasonable failure to give assistance to the public
What behavior is cause for disciplinary action regarding drugs?
Use of illegal drugs, unauthorized use of prescription drugs, use of alcohol while on duty, or a positive drug test.
What is an “employment related act or omission” defined as?
An act or omission occurring during a time that the member was NOT on duty and which will affect the efficiency of gov’t ops or the members performance of their duties.
What is a corrective or adverse action? Who is subject to such actions?
suspension, reduction in grade, or removal which may only be taken against members whom have passed their probationary period.
What notification are members entitled to for notification of adverse action?
15 days advance written notice for proposed adverse action; 10 days for proposed corrective action.
Is Enforced leave considered an adverse or corrective action?
NO and therefore is not subject to notification window.
Who shall reports of infractions be addressed to? When shall these reports be EXPEDITED and when shall they be delivered by?
Repsonsible AFC; Expedited for infractions involving incidents with endorsements, shall be delivered not later than their next regularly scheduled tour of duty
What should be included in a report of Disciplinary Infractions?
facts pertaining to matter and cite actions to be taken without recommending a specific penalty
What actions shall an officer initiate witnessing or receiving reports of disciplinary infractions?
- Interview and Investigate
- Document Facts in Report
- Evaluate and Directly Cite Violations 4. Review Past 3 years of Violations
- Forward up COC to appropriate AFC.
IF the AFC believes additional information is warranted in order to proceed with Disciplinary; whom shall he refer the case to?
