According to the prevention of crime Act 1953 what is an offensive weapon?
It is any article made or adapted or intended for causing injury.
What is a” made” article?
It has been manufactured for the purposes of causing injury to people eg flick knive.
What is an adapted article?
It is an article which has been modified in some way for the purposes of causing injury to someone eg a broken bottle.
What is an intended article?
This can be any article however it is what the person intends to do with that counts. eg a pillow - to suffocate someone.
State the act and section that covers offensive weapons?
Section 1 The Prevention of Crime Act 1953
What reasonable excuse can you have for carrying an offensive weapon?
If a person has a genuine fear that they may get attacked. eg a security guard dropping money off at a bank.
Give examples of unreasonable excuses for having an offensive weapon?
Forgetfulness, Ignorance. General self defence (“just in case”)
Where must you be when for the offence to be complete?
Any public place
Under section 139 Criminal Justice Act 1988 what is the definition of carrying a bladed or sharply pointed articles?
It is an offence for a person to have with them in a public place any article which has a blade or is sharply pointed.
Triable how?
Either way.
What defences are there to possession?
Must have good reason or lawful authority to carry such an item eg use at work, religious reasons, or part of national costume.
