What is meant by a criminal attempt?
It is when someone does not commit the full offence. Used to penalize a criminal who has fallen just short of committing a full offence.
What kind of offence can someone attempt to commit?
It must be an indictable offence which will include either way offences.
In what three areas must the offender show mens rea or criminal intent?
Intention to commit the full offence
Intention to take part in a series of events that would lead up to a final outcome of committing the offence.
The intention to carry out all the elements of the offence
How far should a person go to demonstrate an attempted offence?
The act(s) must be more than merely preparatory. They did not just plan it, they were actively carrying out the offence.
