What must a person do to commit the offence of handling?
Receive, agree or assist in the retention, removal, dsiposal or realisation of stolen goods
What is meant by “receiving”?
It means gaining possession or control. This includes remote possession such as keeping the items in storage.
To commit an offence does the receiver have to gain?
No
In terms of the receiver what else must happen?
There must be proof that goods were received, the receiver must know that the articles were stolen at the time of receipt.
What does retention mean?
continuing to possess something
What does removal mean?
Taking something away from the place where it was.
What does disposal mean?
It means passing on, getting rid of, giving away.
What does realisation mean?
It means obtaining money or profit by selling something.
What is meant by “knowing that an article is stolen”?
A person has been told by the thief or burglar or someone with first hand knowledge.
What is meant by “believing” that an article is stolen?
Uncertain as to whether the article was stolen but then thinking that there is no other likely explanation.
How is it triable?
Either way 6 months to 14 years imprisonment.
