FIFRA
Federal Insecticide, Fungicide and rodenticide act
FIRFA Regulations
regulates the production, transportation, sale use and disposal of pesticides
FIRFA Oversight
administered by the US EPA, enacted by congress
FIRFA Allowances
application to control a target pest not specified on the label if it’s applied to a site that IS on the label, any method of application, application of dosage, concentration or frequency less than the label recommendation, pesticide-fertilizer mixture
FIRFA / EPA Consequence Authority
impose civil / criminal penalties, stop the sale or use of any pesticide, issue removal order, seize products, reevaluate older pesticides, implement programs to require certification of applicators, protect works and handlers from exposure
Two Main Pesticide Classifications
restricted use & unclassified use
Unclassified Use
AKA general use pesticides, normally have a lower toxicity and are less likely to harm humans or the environment - few pesticides fit this category
Restricted Use
classified by the EPA if it exceeds one or more human health toxicity criteria - or is a hazard to a nontarget organism
Certified Applicators
an individual who has been recognized by the state, territory or agency responsible for regulated pesticides as being competent to use or supervise the use of RUP’s
Private Applicators
certified applicators who use or supervise the use of any RUP for the purpose of producing an agricultural commodity on their own property or property they rent / lease
Commercial Applicators
individuals that use or supervise the use of any RUP for any purpose on any property except those under a private applicator
Device
any instrument or contrivance (other than a firearm) used to trap, destroy, repel or mitigate any pest
Pesticide Tolerance
maximum pesticide residue limit that may legally remain on or in treated crops and animals or animal products sold for food or feed - tolerance is set by the EPA before allowing use on food crops
Reregistration
EPA program that reviewed older pesticides (pre 1984) to ensure they met current scientific and regulator standards
Reregistration Eligibility Decisions (REDs)
conclusion of the reregistration process enacted by the EPA for older pesticides
FQPA
enacted in 1996 Food Quality Protection Act, additional amendments to the FIFRA
FFDCA
Federal Food, Drug and Cosmetics Act - called for reassessing existing tolerances and tolerance exemptions to ensure that they meet the legal safety standard
Registration Review
the EPA periodically reevaluates pesticides to ensure that products can still be used safely as policies and practices change
Unlawful FIFRA Acts
distributing anything unregistered, making any advertising claim not included in the registration, selling any registered if the content does not conform to the labeling, selling adulterated or misbranded, altering or defacing any part of container or label, refusing to keep records or permit EPA inspections, advertising w/o giving product classification, making RUP available to a noncertified applicator, use in any manner inconsistent with the labeling
Penalties
civil or criminal, EPA considers the size of the business and the gravity of the situation, intentional violation is a criminal act - can include fine or imprisonment THE LABEL IS THE LAW
Pesticide Containment Regulation
40 CFR Part 165; ensures safe use, refill and disposal of containers
Worker Protection Standard Regulation
40 CFR Part 170; requires employers to provides workers and handlers with certain protections (PPE, decon supplies etc) also requires record keeping
Certification of Pesticide Applicators Regulation
40 CFR Part 171; requirements to become a certified applicator, recertification requirements and standards of competency
Endangered Species Act
illegal to kill, harm or collect endangered or threatened wildlife or fish, or to remove endangered or threatened plants from areas under federal jurisdiction
