Mental Health Act
Allow compulsory admission to hospital for assessment / treatment of a mental disorder
1. Purpose of minimising undesirable affect 2. Least restrictive 3. Respect needs, values 4. Participation principle- involve patient 5. Effectiveness, efficiency and equity
Sectioning
- Referral can be done by medical professional or nearest relative*
- AHMPS
- Approved mental health Practitoner
- 2 doctors
- Assessment can take place in hospital, home, outpatient/ED, suite, GP surgery, police station or custody suit
- A mental disorder of nature or degree that warrants detention in hospital for at least a limited period
- Ought to be detained in the interest of their own health and safety or for the protection of others
MHA sections in summary
MHA
section 2: 28 days. 2 doctors
section 3: 6 months and can be extended but renew each year
section 4: in emergency- 1 doctor (hospital for 72hrs)
section 5(2): temporary detention 72 hours >fy2
section 5(4) psychiatric nurses and learning disability nurses (6 hours) whilst arranging review.
section 7: guardianship. patient in the community where an approved mental health practicioner (AMHP) e.g. social worker requests for compulsory treament.
section 135: police
section 2 of MHA
- allows patient to be sectioned up to 28 days
- signed by 2 doctors and approved social worker (ASW)
- agree that patient is mentally unwell and require full assessment in psychiatric setting
patient must have been examined by the 2 doctors within 5 days of eachother and the 2 doctor can’t be employed by the same organisation. 1 of the doctors should previously know the doctor.
cannot be renewed
the type of disorder does not need to be disclosed
tx can be given against patient’s will
section 3 MHA
treatment order (same as section 2 but for 6 months)
approved social worker must seek consent of the nearest relative. if relative objects then the pt cannot be detained.
6 months (sometimes to 1 year)
treatment can be given but after 3 months the patient needs to consent or a 3rd doctor has to review.
section 4 MHA
emergency order
admission for emergency tx which lasts 72 hours.
signed by doctor and ASW
can be ‘converted’ into section 2
cannot treat against patient’s will this is just for assessment
section 5 MHA
compulsory detention of a patient who has come to hospital voluntarily
section 5(2): temporary detention 72 hours (in this 72 hrs they can be assessed by an approved mental health professional and a doctor (section 12) and either taken off the section or switched to a more appropriate) *Dr must be FY2 or above to detain
section 5(4) psychiatric nurses and learning disability nurses (6 hours) whilst arranging review. .
section 135
police constable can enter patient’s premises and remove the pt to a place of safety for up to 72 hours. can use force if needed be. social worker has obtained warrant. cannot tx against patient will
section 136
same as public space but don’t need a warrant before hand and cannot treat.
section 7
