what are the 5 criteria for detention under the mental health act
- Mental Health Disorder (likely)
- Significantly impaired decision making
- Determining treatment required
- Significant risk (to patient or others)
- Informal/voluntary care not appropriate
what is an emergency detention
undesirable delay in granting a short term detention certificate
Lasts 72 hours in order for assessment
DOES NOT AUTHORISE TREATMENT
need FY2 and above doctor to authorise
No right of appeal
What counts as a mental disorder under the mental health act
Mental Illness
Learning disability
Personality disorder
what is SIDMA
Significantly impaired decision making ability
patients ability to make decisions about medical care is impacted by mental disorder (eg. paranoid about staying in hospital as they think they’re being spied on)
what treatment is done under the mental health act
Assessment to determine treatment needed

what counts as ‘significant risk’ under the mental health act
Risk for patient:
- suicide
- self harm
- wandering
- vulnerability
- deterioration in mental state
- physical health - starvation, dehydration
- poor self care
- retaliation from others due to aggressive behaviour
risk to others:
- aggression
- violence
- sexual assault
- intimidation
- arson
what is a short term detention
up to 28 days for assessment AND treatment
need an approved medical practitioner PLUS a mental health officer
right of appeal for patient
can be extended by 3 days if extra time is needed to put in an application for compulsory order, or 5 days once compulsory order application is submitted
what is a compulsory treatment order
Initially up to 6 months
Approved by medical practitioner PLUS mental health officer
Need reports by 2 independent doctors, a care plan, and a mental health officer report
Need a mental health disorder present
MHO makes application to tribunal, treatment authorised for up to 2 months of detention
Renewal at 6 months then yearly
When can treatment be given in an emergency detention
Only if urgent:
- do save patients life
- to prevent serious deterioration
- to alleviate serious suffering
- to prevent patient being a danger to themselves or others
How is medication given under a short term detention/ compulsory treatment order
2 months of medication is given at a time
exceptions if:
- ECT
- Artificial nutrition
- Vagus nerve stimulation
- Transcranial magnetic stimulation
- medication given to reduce sex drive
- neurosurgery
what is an advance statement
Written statement done while the patient is well
Says how they would prefer to be treated if they became ill in the future
witnessed and dated
regarded in tribunal and by medical practitioner but can be over ruled
what is a patients ‘named person’
someone to support them and protect their interests
act as a representatitive
