What is a restricted patient?
These patients who are subject to a compulsory treatment order but are considered to present a danger to the public.
What is a special patient?
Patients who are detained by way of a court order if they are found to be criminally insane or unfit to plead. The category also includes people on remand for a psychiatric report.
What is a DAOS?
Duly Authorised officers, they are qualified nurses who specialise in the area of mental health.
Who can apply for a compulsory assessment?
Any person who is over 18. Normally, the application will be made by a relative or the doctor who carries out the initial examination.
When do special or restricted patients need to return to the hospital if they leave without authorisation?
Returned to the hospital at any time.
Compulsory treatment patients who is absent without leave or fails to comply with an order need to be returned to hospital within ______ months of going missing?
Three.
What is section 109?
Any members of police may apprehend, any person wandering at large in a PUBLIC place
AND behaving in a manner that gives rise to a reasonable belief that he/she may be mentally disordered
AND the member believes it is the interest of the person or public to do so.
What is section 41?
Assisting DAOs
Any member of police may enter the premises (by force if necessary)
Detain the person in the premises for assessment
OR
Take the person to some other place for the assessment and detain them there.
How long can you detain a person for the purpose of a medical examination?
No longer than 6 hours.
What is section 110C?
Assisting a Doctor
Police may enter the premises (by force if necessary)
Detain the person in the premises until the assessment examination has been conducted.
OR
Take the person to some other place for the assessment and detain them there.
