3 standard conditions of a protection order
No violence, no contact, no weapons.
What is the purpose of issuing a PSO?
When both parties wont leave for the cooling off period and you believe family violence will restart when you leave.
Maximum length of time for a PSO to be issued for is>
10 days.
What is a qualified constable?
Sergeant or higher ranked.
Who cannot have a PSO aganist them?
A PSO can only be issued to someone who is 16 years or over and the order is justified by special circumstances.
Do require consent from the person who is at risk to make an PSO?
No, this way the person who is getting issued with the PSO wont blame the person at risk.
When is a PO deemed permament?
After 3 months if it hasn’t been contested.
Can a 16 year old or older make an application without a representive?
Yes
Conditions of breaching a PO?
The person who is arrested must not be released on bail by a member of police during the 24 hours. The police are still required to bring that person before a court as soon as possible.
When do you have to surrender your firearms license after being issued a PO?
24 hours.
When do you have to surrender your firearms license after being issued a PSO?
Immediately.
