What is the purpose of the Mental health act?
Ensure people receive the appropriate psychiatric treatment.
Section 4
No discrimination
Define ‘mental disorder’
Abnormal state of mind
Continuous or intermittent in nature
Characterised by delusions, disorders of mood, perception, volition or cognition of such a degree that it poses a serious danger to the the health and safety of that person or others
OR
it seriously diminishes capacity of that person to take care of themselves.
Restricted patients
Subject to compulsory treatment order but a risk to the public.
Special patients
Detained by way of court order. Deemed criminally insane or unfit to plead.
What is the Police’s primary role?
To ensure the safety of that person and the public.
What can we do with a non-urgent call?
Refer them to a doctor or a DAO.
When can we remove a restricted patient?
At any time
When can we remove a special patient?
At any time
When can we remove a compulsory treatment patient?
3 months from date. After this, they are deemed to be released from the compulsory treatment order.
Section 41
Assisting a duly authorised officer
- assess a patient
- Transport the patient
- Can enter premises (uniform or ID)
- Can detain there or move elsewhere for up to 6 hours.
Section 109
Mentally disordered person in a public place
-Apprehend a person in a public place who they have RGTB is mentally disordered and it is in the person’s and public’s interest.
Section 110
Assisting a medical practitioner
- assess the patient
- Transport the patient
- Can detain in any place for up to 6 hours.
Who may apply for a person to under go a compulsory mental health assessment.
- Anyone over 18
- Usually a relative or doctor.
How long can we detain someone under the Mental health act?
