What is legislation?
This is when laws are introduced by the government. (failure to follow: demotivate staff, change employee relations, legal action, fined, poor image)
What are examples of legislation?
- Equality act 2010 (equality legislation)
- National Minimim Wage Act 1998/ National Living wage (national minimum wage legislation)
- Health and safety at work act (health and safety legislation)
What is the equality legislation?
This is an antidiscrimination law that covers 9 protected characteristics with different types of discrimination
What are the 9 protected characteristics?
Age, disability, gender, race, marriage status, pregnancy and maternity, religion or belief, sexual orientationn & gender reassignment
What are the 7 different types of discrimination?
- Harassment
- Victimisation
- Direct discrimination
- Indirect discrimination
- Associative discrimination
- Discrimination by perception
- Harassment by a third party
What is harassment?
This is behavoire that is deemed offensive e.g. if you are made fun of for a disability
What is victimisation?
This is when someone is treated badly if they make or supported a complaint made to their manager
What is direct discrimination?
This is when someone is treated less favourably because of a protected characteristic e.g. male over more qualifies female
What is indirect discrimination?
This is when a rule is in place that disadvantages someone with a protected characteristic
What is associative discrimination?
This is discrimination against someone that is associated with another person e.g. you take time off because a relative is sick then get fired
What is discrimination by perception?
Thinking someone has a characteristic and discriminating against them e.g. looking younger than your age
What is harassment by a third party?
This is when employers are liable for harassemt of staff that they don’t themselves employ e.g. outsourcing a part of the business
What are impacts of the equality legislation?
- Organisations may be prosecuted
- Must keep up to date with legislation changes
- Both genderes are paid equally
- Job adverts must not be discriminatory
- Staff must be trained on discrimination ad awareness
What is the national minimum wage legislation?
This states it is illeggal to pay employeed below a certain ammount each hour (minimum wage is legal not ethical)
What are impacts of the national minimum wage?
- Increased costs (may employ less people so harder to find a job)
- If found the minimum wage is not being paid they may be required to may a backdated payment
- Organisations may be fined
What is the health and safety at work legislation?
This ensures employeed are in a safe working envirnment and must be done by the employer
e.g. maintain machinery, training, health and safety policy
What are impacts of the health and safety legislation?
- The correct equipemt must be provided
- Could close of shut down if not compliant
- Legal actions ay be taken by injured staff
