What is a Party Wall Award?

A

A legal document prepared by the surveyor which outlines the following:

1) The sections of the Act that apply and the names and addresses of all parties and surveyors concerned.

2) A description of the works permitted to be undertaken.

3) The rights and requirements of the two owners in relation to the works.

4) Clauses dealing with the execution of the works including any compensation or expenses and the liability of the surveyors costs.

5) The signature of the surveyors and date.

What options does an Adjoining Owner have upon receiving a Party Wall notice?

A

1) Nothing
2) Consent to the works as proposed within 14 days
3) Dissent from the works as proposed within 14 days

If the adjoining owner fails to do anything within 14 days, they are automatically assumed to have dissented.

Is there anything the Owners can do if they are not happy with the contents of the Party Wall Award?

A

Under section 10 of the Act either owner can appeal against the Award to the County Court within 14 days of the Award’s service.
