What is the procedure for an arrestee who is identified as a custodial parent?
The arrestee shall be entitled to make two additional calls for the purpose of arranging for the care of the minor child or children in the parent’s absence. These telephone calls shall be given immediately upon request, or as soon as practicable.

What is the criteria for holding a minor in a “lock-up” for adults?
The minor is 14 years of age or older.
The minor violated a criminal law (Section 602 WIC).
There is reasonable belief that the minor presents a “serious security risk of harm to self or others.”
May not be detained longer than six hours.
The temporary detention is for time to investigate the case, facilitate release of the minor to a parent or guardian, or arrange transfer to an appropriate juvenile facility.
Must be separated from adults (Section 208 WIC).
Must be told how long the incarceration can last.
Must be adequately supervised.

3 Impounding the vehicle pursuant to Section 22651(p), 14602.6, or 14607.6 CVC.

What are the five exceptions for a minor who possess a provisional license to either drive between 2300 and 0500 or transport a passenger under 20 years of age?
(a) Medical necessity.
(b) School or school-authorized activity.
(c) Employment necessity.
(d) Immediate need of family member.

Is an emancipated minor required to carry a note signed by the appropriate person (e.g., physician, school authority, employer, parent, or legal guardian) explaining why the minor must drive (in violation of provisional license) and include the date when the necessity will end?
No documentation is needed for the emancipated minor exemption; however, the minor must have already declared emancipation by completing the appropriate Department of Motor Vehicle (DMV) paperwork.
