Tell me about The Building Safety Act

A

The Building Safety Act received royal ascent in April 2022 and is expected to come into force October 2023

GIVES RESIDENTS/HOMEOWNERS MORE POWER AND PROTECTION

HOLDS ACCOUNT THOSE RESPONSIBLE FOR SAFETY DEFECTS

Historic Claims can now be brought up to 30 years (previously 6)

Future claims Limitation Period extended to 15.

Dutyholders in place during construction phase and Accountable persons during occupation phase

Building Safety Regulator (BSR) within HSE to check at each gateway

3 Gateways used as stop/go checkpoint.
- Gateway 1 at planning stage
- Gateway 2 at Pre-Con stage to ensure Build Regs are met and “Golden Thread” of information in place
- Gateway 3 at pre-occupation stage BSR final inspection and confirms decision within 12 weeks.

A

Buildings greater than 7 storeys or taller than 18m and contain either min 2 residential units, is a hospital or care home
