Who has the right to access the client’s file?
The client or the parent/guardian of a minor
When is it appropriate to share the mental healthcare tx with others?
When the client invites them to an appointment or when the provider determines it is w/in the client’s best interests for them to share information (e.g. crisis, or when client is incapacitated)
What may the thp maintain private form the client that is in his or her file?
Therapy notes or anything that the therapist believes could possibly cause harm to the client if they were to see the information
Who has the right to receive notice of therapy services being rendered to a particlar client?
Parents/guardian of a minor who does not meet state-designated criteria for minors consenting for their own private health care servces
When is a release of information requrired and when is it not?
reuired to provide a client’s private healthcare information to a third party or to even acknowledge that a client has been seen for tx.
EXCEPTIONS: crisis situations, court order directly from the judge
Does a subpoena from an attorney require thp disclosure and/or release of the client file?
Receipt of a subpoena must be acknowldged (cannot be ignored) but it does not require a thp by law to release private healthcare information
What rights do minors have regarding healthcare privacy?
each state differs,so based on that designation, minors do maintain a right to privacy and confidentiality per the discretion of the therapist
