Reasons Board can revoke license
43-39-1 reasons (fraud, felony, false name, negligent, drugs and alcohol)
Unprofessional or immoral conduct that could hurt public
Violation of statute or law in Georgia
Adjudication of mental incompetency
Displayed inability to practice with reasonable skill
Failure to comply with child support order
Default on a loan or other debt
If found in violation of good moral character (committing acts aforementioned)…what consequences exist?
Refusal to grant or renew license, suspension of license
Public or private reprimand
Limit the scope of the license
Mandate treatment of the psychologist
$500 max fine per violation
Impose restitution for the Board’s court costs
When a member of the public files a complaint with the Board
Board has to notify the public member within 30 days as to the outcome of the investigation
Board will also keep them updated throughout the process if they request it
Hearings for complaints
Board will notify you ahead of time that a hearing will take place
Failure to show for hearing - the hearing continues on without you
Revocation and felony conviction
Board can’t revoke a license based solely on a felony conviction, unless the felony directly applies to the job (or unless the felony is already covered as a “crime of moral turpitude”)
Board considers the nature and seriousness of the felony, age of person at the time of conviction, length of time since conviction, circumstances related to the felony, evidence of rehabilitation and fitness for duty
Waiving deductibles and copays
Don’t do it unless the insurance company permits it, otherwise, it’s insurance fraud
Make sure it is based on individual circumstances, and not a regular practice
Affirmations before getting a license
Never lad a license revoked or suspended, or otherwise sanctioned I a different state
Never been denied insurance of a license or refused renewal by a different board
Penalty for practicing without a license
Cease and desist order
If you don’t stop, can impose a new penalty for each day of continued practice
Each penalty is a $500 fine
Release of information
The Board director is allowed to release information on previous investigations to other boards if they so request it
Informing the Board after felony conviction
Within ten days or your license will be revoked
