Tell me about Asbestos?

A

Insulating material which can cause serioud health problems and fatal diseases.
Left undmaged or undisturbed it posses no risk. If damaged or disturbed it can release small tocix fibres which can lodge in the lungs and cause illness.
The 3 types are Brown, Blue and White.
White was illegal in 1999. Others in 1985.
Legal duty to manage asbestos in commericla buildings - non compliance is a criminal offence.
Obligaitions to the duty holder and employer.
Duty holder is owner of the premises if vacant or a tenant if holding a repairing lease.

Refer to asbestos register:

2 types of asbestos surveys:
Management - locate and assess it, advice on its management during normal occupation, no sampling.
Refurbishment/demolition - required where part of premises is needs upgrading or refurbishment or demolition. Sames are taken and analysed. Recommendation are made regard to their management.

Work to be carried out by a licenced contractor. New buildings require architects certificate.

TStages of Complaints Handling Procedure?

A

RICS Guidance Note - Complaints Handling 2016

Firms written CPH must be approved by RICS

Always remember to notify PII ASAP - potential claim for negligence.

Complaints log to show details progress and outcome.

Must have ADR approved by RICS mechanism

2 stages: In House and ADR.

In House - details of CHP should be issued when a firm recieves a complaint. Quick, clear and transparent and impartial. Details of complaints handling officer who they need to contact. Made in writing. Achnowledge in 7 days and investigated within 28 days.

Third Party - If complainant is not happy with the review the second stage involves using independant redress mechanism. Na,e of the redress must be provided to the complainant - such as Centre for Dispute Resolition, The property redress scheme. RICS dispue resolution service.

A

A policy setting out the organisations commitment to health and safety (H&S)
Details of the organisations H&S strucutre with roles and responsibilities for organising H&S.
A risk assessment setting the risks within the workplace and the preventative measures in place.
Details of the planning, implementation of the H&S policy and control measures.

What steps are taken to manage Asbestos?

A

Duty holder must assess whether the premises contain asbestos, if so where is it and what condition is it in. If in doubt material must be presumed to contain asbestos.
Assess the risk and produce an asbestos management plan - encapsulate or remove needed?
Produce an asbestos register
Make the register available to all relevant parties who might disturb it.
Review the register reguarly (HSE says every 6 months).

Criminal action of Asbestos?

A

Only defence is if person took all reasonable precautions and exerised all due dilligence.
H&S Act 2008 enables fines to a maximum of £20k and possibility of 12 months prison. It also enables more serious offences to be tried in higher courts where there are no limits.

A

E - use or part use of any of the following:

Visiting public services - financial, professioanl services, service for commerical business.

Indoor sports and recreation

Medical and health services for vising members of the publoc.

Creche/day nursery

Office - admin and operational function - resaerch and development - industrial process carried out in resi area without detriment to the amenity (smoke, vibration, smell, fume)

Can go from E to E3 if no greater than 1,500 sqm.

F1 - learning and non residential institutions - educatedion, museum, library, public hall, worship etc.

F2 - Local community - shop like convenience store, hall or meeting place, outdoor sport or recreation, indoor or outdoor swimming.

B2 general industrial - anything outside of the new E. – permitted change from B1 B2 or B8 if floor sapce is no bigger than 500 sqm.

B8 - Storage and distrubution. – can change from former B1 to state funded school.
