Family Harm principles that guide Police Practice
CECo SAW
Culturally appropriate (sensitive to cultures, reflect Tikanga for Maori)

PSO/POs and weapons
All weapons. firearms etc must be surrendered. Licence suspended for PSO, revoked for PO.
If seized, report to Commissioner within 3 days (via notifications)
VVS
Must be made by Police employee and within 2 weeks of incident
What must you do with BOPO offenders
You must: Charge offender
Not release from Police custody within 24 hours ( unless for a Court appearance).
Bail can be considered for all FH offenders after 24 hour period, must get authority from Sgt or above
Requirements for issuing PSOs
Family members or intimate partners only. Not flatmates, close personal relationships.
Issued by qualified Const. (Sgt or above)(formally appointed or authorised under 63 of Policing Act ) - NOT Acting Sgts
Allowances for contact when PSO in force
Reasonably nec in emergency
Permitted under condition of PO
Nec to attend FGC
Any court/any matter which is jointly attended.
Things to consider when considering a PSO
Person has/will inflict harm v person at risk/family Welfare of children Hardship poss caused (who has car? Eftpos card? Ability for alt transport/accom, children with high needs levels) Prev Police interactions Alcohol/drug use Mental illness FH history Propensity for violence
PSO duration
As listed on ‘things to consider’ card
Impact on family
Start with 24 hours then factor in considerations.
Factor in weekends, time for support agencies to assist.
PSOs for longer than 5 days usually where PO sought, serious harm likely.
What happens when you arrest for Breach of PSO and what happens for breaches
Before courts within 24hrs (if not then release on summons) Can arrest if fail to appear on summons.
Make complaint to court, sworn by Police officer (not filing a charging doc)
If breach and not located, you have one month to locate, then 24 hours to bring before courts. Can have warrant issued (on NIA for 10 days). After one month warrant must be withdrawn (or after 10 days)
Arrestable offence for PSO…
Failure to remain for service. Fine not exceeding $500
Special circ to issue PSO against 16 or 7 year old
Where behaviour leaves little room for alternative solutions.
Spec circ may include:
RGTB is nec to protect person at risk AND total level of concerrn is HIGH, AND approval from Snr Sgt or above AND they have consulted with OT
Police serve POs when…

Resp believed to be in possession of firearms or
Assessed as risk to server or
Granted without notice
When contact is not a breach for POs
Reas nec in emergency
Permitted under order or written agreement for childcare
Perm under spec condition of PO
Nec to attend FGC
Nec to attend proceeding or meeting where jointly attended
When must a resp surrender weapons and firearms licence?
As soon as prac after PO served (within 24 hours), and on demand made by a Const.
