What is confidentiality?
NON-DiSCLOSURE OF INFO THAT CLIENT OR THIRD PARTIES GIVE TO PSYCHOLOGIST DURING SERVICE PROVISION
What are some complications with confidentiality?
THERE ARE LIMITS TO THIS. UNFORTUNATELY, THESE ARE NOT COMPLETELY CLEAR IN CODE OF ETHICS VITAL TO KNOW WHO THE CLIENT IS AND INFORM ALL PARTIES OF THEIR RIGHTS AND RESPONSIBILITIES
PAYMENT DOES NOT SIGNIFY CLIENT STATUS.
Confidentiality include cases discussed on supervision
Does the person/organisation who pays for the service have the rights to the notes?

For example, if a company is paying for the service; the client still has rights to confidentiality.

1 WHO is the client? who do I owe confidentiality to eg EAP - Coke is paying to see employee who is the client?
Still the EMPLOYEE….it is not coca cola
In your confidentiality - some information you may need to disclose - if you are attending - if you are making progress
You tell the client - what you will disclose - attending/progess/but very limited amount of information - ALL OTHER INFORMATION - from the third party- HR etc is CONFIDENTIAL and YOU NEED CONSENT from the employee to disclose information
What about an 18yr old and Mum and DAD are paying?
- you owe the same confidentiality to the client 18 yr old and or minor over 16yrs
Under 16yrs the parent hold the right to the information
What exceptions might there be to the standard confidentiality rules?
There are some exceptions
MINOR
IMPARED or
INTELLECTUAL DISABILITY
VERY FEW OCCASSIONS to break confidentiality - at risk or someone else at risk
In terms of confidentiality what should be included on the consent form?
Consent form should include who will have access to info and limits to confidentiality.
Include consent form - if I consider it helpful your de-identified may be discussed in supervision
Confidentiality in public places or sporting events? Small towns?
Ways of communicating with client that ensure confidentiality (email, phone, etc)
How long does a psychologist keep a client information for?
Confidentiality must be maintained even if psychologist leaves work place or retires.
Also, if the client dies or the psychologist dies
Can you disclose if a client is at your practice?
NO - ‘I can not comment either way”
What should you do if you come across a client at a sporting event or if they are playing in a team the same as you or a situation like that?
avoid relationship as much as possible - if previous and no professional relationship - discuss how they feel and how you would feel
board would expect for you doing what’s best for your client - maintain confidentiality and not socialise/share those situations with them
What happens when a 3rd party payer wants a progress report in regards to confidentiality?
RULE
CONFIDENTIALITY to 3rd party payers - progress report - this should be in the contract with both the client and the organisation
Always make sure you tell the client but still inform them
What is work cover?
Workcover- must be work injury
What is EAP?
EAP - has a broader brief but still related to the workplace
