what is a right
a right is a tool for making claims against others
rights create, or entail, duties
rights are entitlements (not) to preform certain actions of be in certain states, or entitlements that others (not) perform certain actions or be in certain states
3 essential components of rights claims
subject: the right-holder
content: what the (purported) right refers to
object: the person/body against whom the right is held
what are the 4 categories of rights
- claims
- privileges
- powers
- immunities
define claims
a right that asserts an entitlement to something from another party. Claims entail duties in others
e.g. I have a claim right against my employer to receive my wages
define privileges
a sphere of freedom within which the subject can decide how to act (liberty). this does not entail duties on the part of anyone else, however.
e.g. I have a liberty right to decide whether or not to have long hair or short hair.
define powers
the ability to alter the portfolio of claims; privileges or immunities that you or others have
immunities
a sphere of freedom within which the subject can be assured that no-one can exercise powers which alter their portfolio of claims and privileges

- the right to be treated with respect
- the right to dignity and independence
- the right to effective communication
- the right to be fully informed
- the right to make informed choice and give informed consent
