Ethics 10 Flashcards
Who defines law as “nothing else than an ordinance of reason for the common good, made by him who has care of the community and promulgated”?
St. Thomas Aquinas
What are the 3 properties of law (Thomistic)
- To be directed to the common good
- To direct human behavior according to the order of rightness
- To urge people to do what is juridically prescribed
This type of law is the divine and rational model according to which god created the world.
Eternal Law
This type of law is derived from god and guides man to perform acts in order to reach his or her end which is eternal happiness
Divine Law
Divine law does not contradict human reason but completes it by presenting additional rules for life and behavior
Might appear in T/F
Aquinas said that the natural law is something appointed by reason and nothing else than the rational creature’s participation of the eternal law
Might appear in T/F
This type of law is the process whereby man as a rational being participates in the eternal law.
Natural Law
Aquinas argued that natural law is a law because of man’s participation, and while irrational beings are subject to it, they cannot participate in a rational manner
Might appear in T/F
Man possesses reason which is speculative and practical
Speculative is intellect and practical is will
This type of law emerges when a public person entrusted with care of the community exercises human reason in order to interpret the eternal law and create laws
Human Law

(Man is obliged to preserve his own existence)
