What is this policy for?
It details the processes to be followed and the obligations and responsibilities of the commissioner of police and police employees for resolving employment relationship problems arising during the course of the employees employment.
Who and when does this policy apply?
All police employees and all employment relationship problems
This policy does not apply to?
Independent contractors
A matter that has another specific review or resolution procedure available
A matter that is subject of a claim under the human rights act 1993
Define dispute
A dispute means a dispute about the interpretation, application, or operation of an employment agreement.
Define employment relationship problem
Includes a personal grievance, a dispute, and any other problem relating to or arising out of an employment relationship but
Does not include any problem with the fixing of new terms and conditions of employment.
Define good faith
Both parties providing sufficient information to enable them to consider resolution
Not misleading or deceiving the other party
Listening to others point of view
Being respectful and constructive
Trying to come up with a resolution
Define mediation
Is the process by which the participants get together with the assistance of a neutral person. Systematically isolate disputed issues in order to develop options and consider alternatives
Define personal grievance
Personal grievance means any grievance an employee may have against police because of a claim that the employee has been
Unjustifiably dismissed
Subjected to disadvantage
Discriminated against
Sexually or racially harassed
Subjected to duress
Summary of the employment relationship problem process
Employee raises the problem with manager
Informal dialogue to discuss problem and attempt to resolve it in good faith
Employee may take the matter to another manager or progress the matter to the next step. This may include a personal grievance.
If problem remains unresolved refer matter to mediation
Seek resolution through a more formal process, for example the employment relations authority or human rights commission.
