Title VII
Part of the Civil Rights Act
Forbids discrimination based on race, color, religion, sex or national origin
ADEA
Age Discrimination Employment Act
Prohibits discrimination against individuals 40+
Rehabilitation Act
Gov’t Agencies; federal contractors/subcontractors
Requires affirmative action in the employment of individuals with disabilities
PDA
Pregnancy Discrimination Act
Amendment to Title VII
Treats discrimination based on pregnancy as sex discrimination
ADA
Americans with Disabilities Act
Prohibits discrimination against individuals with disabilities. Disability is defined as having (currently or in the past) a physical or mental impairment (regarded as having such an impairment) that limits one or more major life activity,

Federal contractors/subcontractors with 50+ employees & $50K in federal contracts
Requires affirmative action in hiring women and minorities
Uniformed Services Reemployment & Rights Act
Requires rehiring of employees who are absent for military service
GINA
Genetic Information Nondiscrimination Act
Prohibits discrimination based on genetic information
Lilly Ledbetter Fair Pay Act
Allows employees to make a claim within 180 days of last “incident” where an incident can include getting a paycheck
Equal Pay Act
Men and women must be paid equally if they are doing the same work (with qualifications)
Only applies when comparing men and women

Department charged with enforcing Title VII and other discrimination laws
EEO-1 Report
Questionnaire requesting the number of employees in each job category broken down by racial group (requirement of EEOC for public employers of 100+, or federal companies with 50+/$50K contract)
Disparate Treatment
Differing treatment of employees where the differences are based on the individuals’ race, color, religion, sex, age or disability status
Dispart Impact
A condition in which employment practices are seemingly neutral yet disproportionately exclude a protected group from employment opportunities
BFOQ
Bona fide occupational qualification
Four-Fifths Rule
Rule of thumb that shows evidence of potential discrimination if an organization’s hiring rate for a minority group is less than 4/5 the rate for the majority group
Reasonable Accomodation
an employer’s obligation to do something to enable an otherwise qualified person to perform a job.
Sexual Harassment
Unwelcome sexual advances as defined by the EEOC as:
Submission to conduct is a condition of the individual’s employment
Submission or rejection is used as basis for employment decisions
Conduct interferes with individual’s work environment

Family Medical Leave Act
Allows employee who has been employed for 12 months to take up to 12 weeks of unpaid leave to take care of themselves or a family member (26 weeks for service members)
