What is custodial sentencing?

A

Form of punishment in which a court had decided an offender should spend time in custody

What is the overall aim of all methods of dealing with offending behaviour?

A

Recidivism - tendency to relapse into a previous condition or behaviour in the context of crime it refers to reoffending, usually repeatedly

What is the first aim?

A

The unpleasant expereince of prison is designed to put us off from offending

  • General deterrence - a borad message to members of society that crime will not be tolerated
  • Individual deterrence - preventing the individual from repeating the same crime based in their experiences

What is aim 2?

A

Incapacitation:
The offender is taken out of society to prevent reoffending and protect the public
The need for incapacitation depends on the severity of offence and nature of the offender

What is aim 3?

A

Retribution:
Society gets revenge for a crime by making and offender suffer.
The level of suffering should be proportionate to the seriousness of the crime.
This is based on the biblical concept of “eye for an eye”
Many people think prison is a good way of getting retribution and other forms of punishment may be seen as soft opinions

Rehabilitation:
Some would argue prisons should aim to reform not just punish
Prisons should return to society bettwe adjusted and able to contriute
