ROBBERY: Corcoran v Anderton (1980)
Theft:
One D hit V in the back and the other pulled her handbag. V screamed and D’s left empty handed.
ROBBERY: R v Clouden (1987)
Force or Threat:
D wrenched shopping bag out of V’s hand. Force applied to bag = the person.
ROBBERY: R v Dawson & James (1976)
Force or Threat:
One D nudged V and stole his wallet. Not violence but enough to be classed as force.
ROBBERY: R v Hale (1978)
Immediately before or at the time:
D’s forced into V’s house. D1 stole jewellery while D2 tied V up. They both did not happen at the same time but it was a continuing act.
ROBBERY: R v Robinson (1977)
Mens Rea:
V owed D money and D used a knife to threaten him. D got a fiver. Was his money before so was not guilty.
BURGLARY: R v Ryan (1996)
Entered:
D got stuck in a window and argued that his entrance was not effective. CoA upheld conviction.
BURGLARY: Stevens v Gourley (1859)
Building:
Wooden structure was a building. 16x13 foot.
BURGLARY: B & S v Leathley (1979)
Building:
Storage container used as a freezer was broken into. It had a locking door and electricity. The defendants were convicted of burglary as it was a building.
BURGLARY: R v Walkington (1979)
Part of a Building:
D went into Debenhams and took cash from cash register. Behind the counter was a part of a building so it was burglary.
BURGLARY: R v Jones & Smith (1976)
Trespasser:
D entered his parents house and stole his TV. The defendants were trespassing as they entered without permission.
