24/7 with charging advice.
full code test
A code of practice is used to help decide if a prosecution should take place. Evidential
and public interest test must be satisfied for a prosecution to take place.
evidential test
asks ‘is there enough evidence against the defendant?’. CPS decide if its reliable and credible to provide to the court as a ‘realistic prospect of conviction’
public interest test
asks ‘is it in the public interest for the CPS to bring the case to court?’. prosecution will take place if its in favour of the public interest.
