15 Magdala - How did you assess the validity of the contractors claim of an EOT?
Check if the delay is no fault of the contractor as is reasonable, check against the critical path. Relevant event - variation.
15 Magdala - How did you verify that the additional works were indeed out of the contractor’s control?
Through inspection of the contractors claim. Check schedule of work.
15 Magdala - Were there any specific clauses or provisions in the contract that governed the process for granting extensions of time?
JCT Minor Works Clause 2.7 - CA has a mechanism to agree an extension of time with the contractor.
15 Magdala - Did the contractor provide sufficient documentation or evidence to support their claim?
Photograph, marked up plan, m2 area, quotation and m2 rate.
15 Magdala - How did you communicate your assessment of the extension of time request to both the contractor and the client?
Verbally and formally through ‘notice of extension of time’ certificate outlining the relevant event.
St Marks - Why did you choose that particular contract?
Works were simple in nature, and no contractor’s design required.
St Marks - What defects did you find?
Tarmac repairs, scratches to fence posts
St Marks - Describe your process for assessing the contractor’s valuation.
Checking the percentage complete on site against the claimed percentage.
St Marks - What information did the certificate of practical completion include?
Works, site, date PC was achieved and when the defects liability period ends. State the contractor is to complete all outstanding defects remaining.
St Marks - What was your approach to managing any outstanding defects identified.
Instruction to make good and agree a date for the defects to be rectified. Schedule of defects issued at the end of the rectification period. Issue a cert. of making good defects and then the final cert. to release retention.
What is JCT minor works with contractor’s design?
The employer must provide drawings, a specification, or work schedules to define the quantity and quality of work, as well as the requirements for the Contractor’s Designed Portion.
What is the JCT intermediate building contract?
The employer must provide drawings and either bills of quantities, specification, or work schedules to specify the quantity and quality of work.
The price and payment structure of the contract is based on a lump sum with monthly interim payments.
It can be used where provisions are required to cover named specialists.
All sub-contractors are domestic and their performance is the responsibility of the contractor.
