1) Aggrieved employee presents in writing within 5 working days the employee knew or should have known of the grievance through proper channels to the Deputy Chief. Deputy chief 5 days to respond in writing. If not resolved within 5 days employee must document on union grievance form and present to union Executive Board. Exec board shall meet to discuss within 30 days. 2) Exec board presents to the Fire Chief within 5 working days. Fire chief shall respond within 5 working days. 3) present to Human Resources director within 5 working days. Will meet within 5 working days 4) submitted to arbitrator within 10 work days. arbitrator decision final. (12)
What is a grievance?
A difference, dispute, or complaint between the city and the union as to the application or interpretation of this agreement. (11)
What shall the grievance specify? (4)
1) Date of the grievance 2) specific articles of the agreement that were violated 3) basic facts pertaining to the grievance 4) relief requested. (11)
When shall a grievance be presented directly at Step 2?
When it involves discipline in the form of suspension, demotion, or termination. Or when it is general in nature in that it applies to a number of employees having the same issue. (12)
Where is arbitrator selected from?
Mutually selected from Federal mediation and Conciliation Service. Decision is final and binding on both parties. (12)
Who pays for arbitrator?, Court reporter?
Fee shall be equally divided. Court reporter paid by party making request, if both parties then they split. (13)
