What happened in Gideon vs Wainwright?
Gideon was denied an attorney because he wasn’t poor and so he defended himself and got 5 years in prison. Then the SC heard his case and changed it so everyone gets an attorney
Miranda vs Arizona
Miranda was a kidnapper/raper and after being interrogated without his rights his confession was used against him and he got 20-30 years. Then the Supreme Court said under the 5th amendment he had to be told his rights so he was free but then Arizona retried him and he got 20-30 years again
The prosecution for the same offense twice is called what?
Double jeopardy- under the 5th amendment it’s not allowed and the court can’t impose more than one punishment for a single offense
What does the 3rd amendment say?
The US cannot quarter soldiers in private homes without the owners consent in peacetime
What does the fourth amendment say?
There shall be no unreasonable searches and seizures without probable cause and a warrant
What is the exclusionary rule?
When evidence against someone is illegally collected it is sometimes inadmissible for criminal prosecution
What is the 8th amendment?
No cruel or unusual punishment but the death penalty is okay as long as it is carried out in a certain manner
What did brown vs the board of education rule?
Separate but equal
Bakke vs UOC
Bakke was in his thirties and wanted to go to college for medical school but was rejected because he was too old and the college was letting blacks in ahead of him. Bakke brought a lawsuit and the college was forced to let him in
What did the court rule on the Dred Scott Vs. Sandford case?
Dred was a slave who was brought to a free state and the SC said he was still a slave (Rodger Taney was the Chief Justice)
