How is licensure and registration related to scope of practice? How is registration different than licensure?
licensure is the strongest type of regulation. registration is a weak form of regulation
What is the purpose of defining a scope of practice?
legally articulates the domain of OT practice and provides guidance to facilities, providers, consumers, and major public and private health and education facilities about the appropriate use of OT services and practitioners. it can further ensure important patient protections particularly in the investigation and resolution of consumer complaints involving fraudulent or negligent delivery of OT services.
Who is ultimately responsible for regulating occupational therapy and to assuring the state practice act is up to date with current practice?
OT SRB’s may discuss the need to amend state OT practice acts or regulations to keep them up to date with current practice
How can a state OT association (like NYSOTA) be involved in amending the state OT practice act
state OT associations or individuals can propose changes in the practice act or statutes through legislative amendments. they also can attend hearings and comment on amendments to regulations that are proposed by SRB or advisory council and work with them to initiate needed changes.
What is the main purpose of regulation through licensure or registration by the state?
generally include demonstration by the applicant that he or she has successfully completed academic fieldwork requirements of an educational program for OT or OTAs that is accredited by ACOTE
How often do you have to renew your license in NY state?
every 1 or 2 years. in NY its 3 years.
In addition to a fee, what is the OT also required to do to renew license?
completion of a specific amount of continuing competence activities.
In addition to revoking a license what are some less harsh methods of disciplinary actions?
less harsh actions may require peer review of records. educational meetings, supervision with or without a mentor, CE, payment of a fine, suspension of a license/certificate or registered status.
