- Established 1964
- For preventing corruption in central government.
- on recommendations of Santhanam Committee
- Got statutory Status in 2003
- In 2004 it was confered upon to receive & act on complaints by Whiste Blowers
- Only designated agency to take action against complaints making motivated or vexatious(causing or tending to cause annoyance, frustration, or worry) complaints.

Composition:
1 Central Vigilance Commisioner(Chairperson)
2 (max) vigilance commisioner
Appointment:
By president on recommended by ->PM+Union Home affairs minister+Leader of opposition in Lok sabha.

4 Years or 65 age(Whichever earlier).
Post tenure can’t work with central or state government.
On which ground president can remove central vigilance commisioner or any vigilance commisioner form office?
- Insolvent
- Engaged in paid employement
- unfit to continue
- unsound mind
- imprisonment
In addition president can remove on proved misbehavior->that case->matter goes to SC->IF APPROVED->REMOVE
He is deemed of misbehavior :
(a) If interested in contract or agreement by centre.
(b) participates in any way in profits of such contract

1.Secretariat:
Consistes of secretary,joint secretaries,deputy secretaries,under secretaries & office staff
- Chief Technical Examiner’s wing:
- Technical wing
- Has chief & supporting engineers
Functions:
a) Audit government constructions from vigilance angle
b) investigating construction related cases
c) assisting CBI in technical related cases
d) giving advice/assistance to CVC in technical matters.
3.Commissioners for departmental inquiries
They function as inquiry officers in proceedings against public servants.
What are the functions of CVC?
1.Inquire on reference of government where public servant of following category has violated prevention of corruption act,1988
a) All India services serving in Union & Group A officers of central government.
b) specified level of officers of authorities of central government.
2.To exercise management ,give directions & to review progress of investigations of CBI in investigations related to prevention of corruption act,1988
- advising central government
- Exercise management over vigilance administration in ministries of central government & authorities
5.Manage the vigilance administration in ministries of central government
- To inquire or cause an inquiry in public interest disclosure,protection of informers resolution
- >recommend action
7.Center consults CVC in rule making of of vigilance & disciplinary matters related to central & All India Services
8.Director of Enforcement is appointed by Center on recommendations of committee
->C V Commissioner(Chairperson) + 2 vigilance commissioner + Secretaries of M/o Home affairs + D/o Personnel & Training + D/o Revenue in M/o Fianance.
Further this committee on directions of Enforcement officer recommends & appoints officers for posts above level of deputy director of Enforcement.
- CVC Is a specific authority to receive information relating suspicious transactions under prevention of money laundering act,2002
What Changes were made by Lokpal & Lokayuktas Act (2013) in CVC Act(2003) &Delhi Special Police Establishment Act (1946) & in functions of CVC?
- Director of Prosecution in CBI->On recommendation of CVC
- Committee to appoint officers of post SP and above CBI Consists of->CV Commissioner + 2 vigilance commissioner + Secretaries of M/o Home Affairs +D/o Personnel & training
- CVC->Empowered to inquire Lokpal reffered complaints against officials of A,B,C,D
Mention in brief the working of Central Vigilance Commission.
- Has power of civil court
- can call for information or report from central government to exercise supervision over vigilance & anti-corruption work in them
- CVC advises central government about further action to be taken(Not sure if it’s suo motu or something)->if Government doesn’t think that these advises are appropriate they shall communicate the reasons to CVC
What is Chief Vigilance Officer?
- Present in all ministries in Union Government->heads vigilance division of concerned organisation
- Link between his organisation & CVC;
- Link between his organisation & CBI.
Vigilance functions performed by CVO include
1) collecting info about corrupt practices of organisation’s employees
2) Investigating verifiable allegations reported
3) Processing investigation reports for further consideration of desciplinary authority concerned
4) Referring matters to CVO for advice whrever necessary
Enlist Salient features of Whistle Blowers Protection Act.
- It’s a Mechanism to protect identity of whistle blower
- It provides system to disclose information about corruption or willful misuse of power by public servants ,ministers.
- A person can make public interest disclosure on corruption before a competent authority(Which is CVC as of now)
- Up to 2 yrs jail & up to 30000 fine for false & frivolous complaints
- Disclosure->should be in good faith & substantially true.
- Disclosures can be in writing or email.
- No action shall be taken on disclosure if it does not indicate identity or indicates fake identity of complainant or public servant.
- Not applicable to Special Protection Group(special force for providing proximate security to the Prime Minister of India and members of their immediate families wherever in the world)
