-the european convention of human rights is incorporated into the human rights act in 1988 arguably this provides inadequate gurantee of citizens rights in relationship with the state
house of lords lacks democratic legitimacy
-Membership predominatly chosen by PM, since 2000 an independant HOL appointments commission
-ensures there is a diverse range of experince but none are elected
