Amendment 2
This is the gun amendment
-Have the right to have militias
-Allowed to have guns
You have limits to having a gun though some of these might include:
- Background Check
-None on school grounds
-Not in your car
-Police and FBI are allowed
Amendment 3
Ties into the Quartering act
Can’t have soldiers stay in your house unless you are in war.
The act is outdated for modern day
Amendment 4
Ties into Writs of Assistance. Now you have to have a judge give you a search warrant to search a house or a barn.
Amendment 5
-Grand Jury
To make sure the government is not abusing it’s power and they approve if the trial should go forward.
-Twice Put in Jeopardy
Can’t be tried for the same trial twice for the same crime. Even if your innoncent
-Witness against himself
The right to plead the 5th
-Due process of law
Everyone has to follow the same steps so no one can abuse their power
Amendment 6
A speedy meaning reasonable time trial. A public trial because during the Boston tea party you couldn’t go to the public trials because it was in England
Amendment 7
If you end up in a civil case with someone, and you can have a jury, you have the right to a jury and the jury cannot be taken away
Amendment 8
Excessive bail. You are paying money to get out of jail (paying bail)
If you pay, the trial might be in a while so if you come back to trial you will get your money back.
Cruel Punisments
Starving
whipping
torture.
Amendment 9
In the constitution, if there is a right that we all agree and it’s not a right, it is still a right. Society has to agree on the right though.
Amendment 10
If it is not listed in the constitution, it is not a job for the federal government. It is a job for the states. Example people vote differently in every state.
