Contractual clauses in the Conditions of the Contract:

A. Have priority over Division 01

B. Are superseded by Division 01

C. Are expanded upon by the provisions of Division 01

D. Are independent, and Division 01 provisions have no effect

A
  • Contractual clauses in the Conditions of the Contract:*
  • A. Have priority over Division 01*
  • B. Are superseded by Division 01*
  • C. Are expanded upon by the provisions of Division 01*
  • D. Are independent, and Division 01 provisions have no effect*

C. Are expanded upon by the provisions of Division 01

The key word is “expanded.” Division 01 General Requirements are detailed. They address administrative and procedural level issues. The Conditions of the Contract say: “Do this.” The General Requirements say: “Do it like this.” And don’t forget the concept of “complementary documents.” No provisions have priority over, are superseded by, or are independent of, other provisions in the contract documents - they are “complementary.”

The dollar amounts of cash allowances are:

A. In the Instructions to Bidders

B. On the Bid Form

C. In Division 01

D. In the specification sections of Division 02 through 49 that specify the product installation

A
  • The dollar amounts of cash allowances are:*
  • A. In the Instructions to Bidders*
  • B. On the Bid Form*
  • C. In Division 01*
  • D. In the specification sections of Division 02 through 49 that specify the product installation*

C. In Division 01

To avoid duplication and possible contradiction, the single place the actual dollar amounts are given are in Division 01 Section “Allowances.” All other documents, including the bid form, refer to that location. Some AEs prefer to have allowance amounts incorporated in the bid form; great care must be taken to ensure that this does not introduce a conflict within the documents.

Standardized agreements forms are composed assuming the use of the related conditions of the contract document published by the same source association. In order to achieve the benefits of using standard contract forms, they must be consistently used across the body of the project’s contract forms.

The document named “Available Information” is part of the:

A. Instructions to Bidders

B. Contract Documents

C. Specifications

E. All of the above

D. Procurement Requirements

The “Available Information” document is a convenient location for data that is not part of the contract but may be useful to assist Bidders in understanding the project. These documents are not incorporated in the construction contract under the A201; however, some owner general conditions or supplementary conditions do incorporate bidding requirements in the construction documents, a practice that CSI strongly advises against.

Insurance requirements are defined in AIA Document A201, Section 11, Insurance and Bonds, and the Insurance and Bonds Exhibit.

The owner is required to carry all-risk type property insurance per Exhibit A, Section A.2.3.1. Property insurance deductibles are paid by the owner as the policy holder, not by the contractor.

Section 11.2.2 of AIA Document A201 states that if the owner fails to purchase property insurance, the contractor may delay the start of work and purchase insurance to protect their interests. In this case, the contract time and sum may be adjusted by change order. If the owner does not purchase required insurance and does not notify the contractor of this decision, the owner becomes responsible for all losses that the property insurance would have covered.

What are the four Cs for effective communication?

A

Answer: Clear, concise, correct, and complete.

Reference: PDPG 11.3.6 p. 259

Explanation: As legally enforceable contract documents, construction specifications should be prepared with concern and respect for their legal status. The four Cs for effective communication are:

  • Clear. Use proper grammar and simple sentence construction to avoid ambiguity.
  • Concise. Eliminate unnecessary words, but not at the expense of clarity, correctness or completeness.
  • Correct. Present information accurately and precisely. Carefully select words that convey exact meanings.
  • Complete. Do not leave out important information.
61
Q

True or False:
Repetition of information on both drawings and specifications is a good way to emphasize its importance.

A

Answer: False

Reference: PDPG 11.5 p. 294

Explanation: Duplications violate the CSI principle of “say it once and in the right place.” Duplication is an opportunity for discrepancies that alter the uniform basis for procurement and cause confusion. In turn, this can result in higher construction costs, faulty construction, disputes, decreased document credibility, and increased exposure to liability.

A

Answer: True

The supplementary conditions should be coordinated with the owner/contractor agreement.

Reference: PDPG 12.3.3.3, p. 318

Explanation: Properly prepared contract documents agree with one another as integral parts of the whole. The contract documents should agree with one another in terminology and nomenclature. Modifications made to one of the forms should not contradict provisions contained in the other forms. The supplementary conditions must, therefore, be carefully coordinated not only with the general conditions, but also with the other forms, including procurement requirements and the various agreements.
