FDNY premises?
Any FDNY division or battalion office, firehouse, ambulance station, or other location owned, leased or operated by FDNY including parking facilities ADJACENT to such premises
Prohibited conduct:
Use, positive presence, possession, attempted possession, sale, transport or delivery of ANY ILLEGAL DRUG, while ON or OFF DUTY: or while in uniform or while in any Dept. premises, property , vehicle
Use, possession, sale, transport or delivery of any DRUG PARAPHERNALIA (NEEDLES) While ON DUTY; IN UNIFORM ; OR WHILE IN ANY DEPT. PREMISES, PROPERTY OR VEHICLES
Use, positive presence, possession, sale, transport of alcohol or related paraphernalia (beer taps, beer kegs) while on duty; in uniform; dept. premises /vehicle
Any use of alcohol that may elicit POSITIVE TEST WHILE ON DUTY
REFUSAL TO COOPERATE IN ANY SUBSTANCE TEST ORDERED BY THE FD, including completion and signing of forms
EVERY MEMBER (on or off duty in any dept. premises, vehicle) who REASONABLY SUSPECTS OR KNOWS of a violation of this policy is required to report the viOLATION IMMEDIATELY to the OFFICER ON DUTY AT LOCATION OF VIOLATION, or NEXT SUPERIOR…ANY member failing to do so, is subject to disciplinary action..
Any member (light or full duty)taking PRESCRIBED MEDICATION, that might be impairing the mental or physical ability to fulfill his or her work duties shall IMMEDIATELY notify commanding officer…no member is required to reveal confidential info…member may provide simple statement…Officer should seek determination from BHS, by ordering member to BHS FOR FITNESS FOR DUTY DETermination….OFFICER shall document referral in UNIT JOURNAL
Every OFFICER who observes member exhibiting possible signs of alcohol or drug abuse shall consult CSU and may refer member to CSU
EVERY OFFICER (on or OFF DUTY, while in any Dept. premises, property or vehicle) who reasonably suspects or knows that any member has engaged in conduct prohibited by this AUC shall immediately:
P.R.O.B.B.E.
P- prohibit on and OFF DUTY members present at time of discovery of any violation of this policy from LEAVING PREMISES, without permission of INVESTIGATING OFFICER(investigating officer is not the aforementioned officer that reasonably suspects the violation) –IF ANY MEMBER IS PERMITTED TO LEAVE (INVESTIGATING officer will document reason for release to Chief of Dept.)(bluff: officer on duty)
R-Relieve the ON DUTY members from emergency response duty
O-out of service- AFFECTED UNIT
B-Battalion Chief notification—or if appropriate/next superior
B-notify BITS
E-entry in company journal

All testing may be conducted by?
BHS, BIT, TESTING UNIT
Members subject to drug and alcohol testing pursuant to agreements with the Dept., may tested ?
while ON DUTY at ANY WORK LOCATION
- TESTING UNIT will administer test
- members supervisor (officer) shall be responsible for PROMPTLY locating the member and ensuring full and prompt cooperation with TEsting unit personnel
Members shall NOT make any public announcement over the intercom or otherwise regarding the arrival of the TESTING UNIT (or BITS/DOI)
Light duty- member will have to report forthwith/transportation provided–COMMANDING OFFICER will notify light duty member to report to testing unit–transportation provided
..For a member who has singed a TESTING AGREEMENT, Testing unit personnel will call OFFICER ON DUTY, after start of tour, to ascertain that the member is working, OFFICER will NOT notify member.
MEMBER IS NOT TO BE NOTIFIED UNTIL TESTER ARRIVES
When TESTING unit arrives, OFFICER WILL direct member to report where?
COMPANY OFFICE - where member receives further instructions
A request to provide urine blood constitutes?

DUTIES of INVESTIGATING OFFICER…
do not confuse with oFFICER ON DUTY
- conduct roll call (on and off duty members)
- advise OFFICERS and FF’S of their right to representation (bluff for officer duties )
- following notification/conduct investigation
- if OFFICER has reason to believe this policy has been violated, immediately order such member(s) tested for alcohol and illegal drugs…document reasons in report to CHIEF OF DEPARTMENT / if oFFICER believes there is NO reason for test/ also DOCUMENT IN REPORT TO CHIEF OF DEPARTMENT (both situations/report )
EVERY member operating Dept. vehicle that has been involved in a MAJOR ACCIDENT..(defined by SB 56)
SHALL BE TESTED FOR DRUGS/ACOHOL
- highest ranking officer at the scene shall ensure such testing with TESTING UNIT
- -if member is transported to hospital , MEDICAL OFFICER shall ensure testing with TESTING UNIT, BIT, ETC.
RETESTING …
- -WITHIN 30 DAYS of notification of result , submit request for retest (T-3) TO BITS, seeking retest at laboratory other than original test
- specimen is suffice for additional testing (not new specimen)
- member’s expense
- specimen from laboratory to laboratory (NO HANDLING BY MEMBER or agent of member)
- 2nd laboratory provides results directly to DEPARTMENT
- laboratory is certified by NYS DEPARTMENT OF HEALTH AND APPROVED BY DEPT. for such testing

A LINE UNIT IS deemed unavailable if…
emergency and does not transmit 10-8 within 60 minutes upon testing unit arrival
