What is the order of titles and ranks in Massachusetts State Police?

In the event the Colonel/Superintendent elects to fill a vacancy he shall or she shall do what?
He or she shall pronounce his/her intention to do so within 60 days.
How long does the Colonel have to promote individuals in vacancies?
60 days or if the Colonel issues a written order to the Division of Administrative Services within 60 days special specifying the reason that shall prevent them filling such vacancies.
What are some reasons the Colonel may not be able to promote in a vacancy?
1) The abolishment or consolidation of a section or unit of the MSP
2) Insufficient funding
3) The assignment, reassignment or transfer of any uniformed member within or among a division or divisions of the MSP and/or the staffing needs of any such Division or ongoing staffing study or any change in duty within a particular rank.

Conduct unbecoming shall include that which brings a MSP member into disrepute or reflects discredit upon a person as a member of the MSP or which impairs operation, efficiency, or effectiveness of the MSP or the member.

Members shall not associate with individuals they know or should know are engaged in criminal activities.

They shall obey all laws of the United States and of any country, state or local jurisdiction in which the members are present.

4) The failure to take appropriate action on the occasion of a crime, disorder, or any condition deserving MSP attention.

5.8.3 What is another indicator of unsatisfactory performance?
Repeated infractions of MSP rules, regulations, policy, procedures, orders, directives or any combination of shall be considered prima facia evidence of unsatisfactory performance.

1) Members shall not or shall not permit any person to store or bring any alcohol or drugs into a MSP facility or vehicle except which is held as evidence in the course of official duties and less authorized by the Colonel/superintendent.
2) Members shall not possess or use any controlled substance not prescribed.If prescribed the member must notify the duty assignment supervisor fourth with if it may impair the members ability to perform their official duties.
3) Member shall not consume alcoholic beverages while in uniform.
4) Member shall not consume alcohol beverages while on duty except in the performance of duty while acting under specific orders for my supervisor member.
5) Members shall not Appear for duty, or be on duty, while under the influence of alcoholic beverages to any degree whatsoever with an order of alcoholic beverages on their breath.
5.12 What are three things that are considered insubordination?
Insubordination would be if members did not do the following:
1) Promptly obey any lawful order conveyed to them by any senior member in writing or verbally.
2) Members shall not assault, strike, threaten, draw or lift up any weapon, or feign or fake violence against any employee of the MSP or civilian employee.
3) Members shall not use threatening or insulting language or behave in any insubordinate or disrespectful manner towards any employee of the MSP.
5.13.3 Whenever there seems to be a conflict or doubt and the meaning of written MSP rule read policy procedure order a directive application shall be what?
The application shall be made in writing through channels to the colonel/superintendent for an explanation or possible correction.
5.14 What could happen if any member directly or indirectly receives a reward gift or gratuity on account of his official services?
That member shall be subject to criminal sanctions and discharge from office.
5.14 If a member is given an award of plaque citation or any other articles of appreciation recognizing meritorious service or accomplishment does that fall under a gratuity for award bribe or gift

5.15 What is considered an abuse of position?
1) And official uses their position, identification card, or badge for personal gain
2) For obtaining privileges not otherwise available to them and less in the performance of duty
3) For avoiding consequences of illegal acts like speeding etc.
5.15 What kind of class a violation is the abuse of position?

5.15.2 What shall members not authorize the use of?
Members shall not lend to another person there issued uniform parts, equipment, identification cards or badges, nor permit such identification cards and badges to be photographed or reproduced without specific approval of the Colonel/Superintendent.

Shall not commit any acts against or a omit any acts which constitutes a violation of the MSP’s rules, regulations, policy, procedure, order or directive.
5.5.1 In reporting for duty what shall constitute an order to report under the section?
A notice issued by any court shall constitute a report for duty under the section.

A member assigned to a patrol or post shall not leave the patrol except for police necessity or personal necessity
If a member is required to quit their post what shall they do?
A member Shall first received permission to leave from there duty assignment supervisor or proper authority.
5.9 When is it OK to get employment outside of the department?
When you submit in a written request for after the employment through channels to the Colonel and you are approved prior to me starting the outside employment.
2) Such employment shall not create any conflict of interest or violate MGL 268A or any other law.
3) if the job renders the member unavailable for an emergency.
4) If the job physically or mentally exhausted member to the point that they can’t perform at work for the MSP
5) If the job job brings a member and or state police in to disrepute
6) If the jobs hours require special consideration for the scheduling of the MSP regular duty hours or court appearances.
5.9.1 What is a limitation of employment outside of the department?
Outside employment shall not interfere with the members MSP employment.
5.10 What is the basic rule about alcoholic beverages and drugs as a MSP member?
MSP member shall not bring booze into any state facility or alcoholic beverages into any state vehicle same goes for controlled substances or drugs and less in their official performance of duties. They never drink in uniform, smell like they have alcohol on their breath, and she’s not to appear for duty under the influence of alcohol.
5.11 What are the basics of using tobacco tobacco gum and other foreign objects in your mouth
If hired after January 1, 1998 no member shell smoke or use any tobacco product. No member is allowed to smoke in any building or vehicle unless that vehicle is assigned to that member and they are alone. When in uniform members still not used tobacco chew gum or have any foreign objects in their mouth and the view of public or in formation.
5.12 What are the basics of insubordination
Members and Shall obey any lawful order given to them by a senior member. Member is still not hit or threaten or feign violence or pull their weapon or be disrespectful to on any MSP member or civilian member of the MSP.
5.13 What shall a member do if they are given conflicting or illegal orders by a supervisor?
They are responsible for pointing out the conflict to the senior member.It’s even after it is pointed out and they were still ordered to do that the responsibility lies solely on the senior member or person issuing the order.
5.13.2 When Shall a member not follow a direct order
If they know that it would require them to commit an act in violation of any law.
5.13.2 If a member is given an order that would require them to commit and act in violation of the law what shall they do?
They should inform the senior member, if still so ordered, they shall be allowed reasonable time to confer with a senior member within their division, if order is not overturned, and member still refuses to follow the order then they will then get in trouble and have to explain it in writing to the Colonel/Superintendent.
5.13.3 What happens when there seems to be a conflict or doubt in the meaning of a written RRPPOD?
If this ever happens they shall put in writing an application to the Colonel/Superintendent ask asking for explanation or a possible correction.
5.14 For gifts gratuities bribed a rewards any member who directly or indirectly receives a reward gift or gratuity of his official services shall be subject to what?
That member shall be subject to criminal sanctions and discharge from office.

When any member uses her position official identification card or badges for personal gain obtaining privileges or avoiding consequences of illegal acts.

It is a Class A Offense.
5.15.2 May members lend another person their equipment, uniform, and identification or badges?
A member shall not lend any of their items given by the state police to any person including another member especially weapons.

May not allow them to be photographed or reproduced without specific approval by the colonel/superintendent.
5.15.3 What should members remember not to do and connections with testimonials advertisements commercial enterprises or political purposes?
Members shall not authorize the use of their names, photographs, likenesses or official titles identifying them as a MSP member.
5.15.5 What may members not do between criminals in their victims?
Members shall not become directly or indirectly involved with any arrangements, agreements, or compromises between criminals and the victims without first receiving permission from their duty assignment supervisor and consulting with the appropriate prosecuting attorney play all
