What is termination management?
Termination management is where the employee leaves a particular workplace, ending the employment relationship.
What are the types of termination?
(DRRR)
- Retirement
- Redundancy
- Resignation
- Dismissal
What is voluntary termination?
Where the employee decides to leave the business.
What is involuntary termination?
Where the business decides to terminate the employee.
What is retirement?
Retirement is where the employee decides to permanently leave the workforce.
What are the entitlement considerations for retirement?
Employees are entitled to any accrued benefits.
Annual leave and long service leave.
What are the transition considerations for retirement?
- Allow employee to gradually transition into retirement (gradually reduce work which will assist for succession planning)
- Provide advice or counselling (lifestyle and financial)
What is resignation?
Resignation is where the employee voluntarily leaves the business, usually to go to another job.
What are the entitlement considerations for resignation?
- Payment for completed work and accrued benefits
- Business entitled to notice (based on agreement/contract)
What are the transition considerations for resignations?
- Carry out an offboarding process (exit interviews, handovers)
- Its important the business conducts an exit interview to determent reason
What is redundancy?
Redundancy is when an employee leaves the business because their job no longer exists.
What are entitlement considerations of redundancies?
Employees are entitled to redundancy package, notice, pay and benefits for work conducted, time off to attend interviews.
What are transition considerations of redundancies?
Counselling, outplacement service, career advice and training/financial advice.
What is dismissal?
Dismissal is when an employee is terminated due to unacceptable behaviour or performance.
What is summary dismissal?
When an employee commits a serious breach of their employment contract and can be dismissed immediately. Theft, serious breach of OH&S, sexual harassment etc
What is an on-notice dismissal?
When an employee is not performing satisfactorily, they must be given notice and an opportunity to improved their performance.
What are the entitlement considerations of dismissal?
Employees are entitled to pay and accrued benefits for the work they have performed.
What are transition considerations of dismissal?
Some businesses may introduce career transition services for underperforming employees.
What is unfair dismissal?
Unfair dismissal occurs when an employee has been dismissed in a harsh, unjust or unreasonable manner.
- Absence from work due to illness or injury
- Belonging or not belonging to a trade union
- Discrimination
