What is required of an employee who is prescribed legal drugs?
The employee should ask about side effects that can impair job function
If so, the employee shall obtain a statement from the medical professional indicating any work
restrictions and the duration of those restrictions
The employee is required to present the statement to the Human Resources prior to reporting for duty
Employees with work
restrictions will be placed on leave but will be allowed to utilize their sick leave benefits
during the period the restrictions are in effect

A. Pre-employment: Employees in safety-sensitive positions
B. Reasonable Suspicion: All employees

Which employees can be randomly tested?
those in safety-sensitive positions
The minimum annual percentage rate for random drug and alcohol testing shall be
approximately 50%
When must the testing company notify the district chief of the test

When must drug testing occur with or without reasonable suspicion for motor vehicle accidents?
(1) the driver was performing in a safety sensitive position with respect to the
vehicle and the accident involves the loss of human life;
OR
(2) the driver, regardless of whether he/she was performing in a safety sensitive
position, receives a citation for a moving traffic violation arising from the
accident AND the accident involved:
(a) bodily injury to any person, who as the result of the injury, receives
emergency medical treatment away from the scene
OR
(b) disabling damage to any vehicle, requiring tow away.
Testing threshold for alcohol
If the result of a breath alcohol test is .02 or greater, a confirmation test must be performed.
This confirmation test must be conducted at least fifteen (15) minutes but no more than
thirty (30) minutes after the completion of the initial test. Once confirmed, if the alcohol
concentration is at least .02, but less than .04, the employee shall not be permitted to return
to duty for that work period, as a precautionary measure. The employee will be required to
use sick leave for the remainder of the shift.
