PERSONS WEARING KIRPANS WITHIN YORK REGION COURT FACILITIES
- Upon arrival, any person wishing to enter a York Region court facility wearing a Kirpan, must identify as Khalsa Sikh and inform the front door security staff or Court Operations Sergeant that they are carrying a Kirpan
- the maximum total length of a Kirpan including the sheath, shall not exceed 19.5 cm (7.5 inches) with a blade of not more than 10.16 cm
- The Kirpan must be worn in keeping with the Sikh faith, including. Secured in its sheath, secured to a fabric belt, worn across the torso, remain so throughout that court facility attendance, such as the Kirpan is not readily removable. The Kirpan must be worn under clothing and not be easily accessible and remain so throughout the court facility attendance.
In any case, where an individual is not in compliance with the admittance of Kirpan stipulations, or risk factors have been identified which would determine a Kirpan should not be admitted, York Regional Police reserves the right to refuse admittance to the individual while in possession of the Kirpan.
Duties of Court Operational Sergeant
- Conduct an interview with the individual wishing to gain entry in order to assess the risk to public safety of those using the court facility
- whenever possible, conduct the interview away from busy public areas of court facilities in order to maintain privacy of the involved individual.
- conduct a risk assessment from a general risk-based perspective which may include, but is not limited to the following.
i: the reason for the person attending the court facility
What are the signs and symptoms of Excited Delirium?
(i) fear;
(ii) panic;
(iii) shouting;
(iv) violent aggressive behaviour;
(v) sweating/fever;
(vi) hot to the touch;
(vii) removes clothing;
(viii) exceedingly high pain tolerance/threshold;
(ix) extraordinary strength; and/or
(x) delusions/hallucinations.
What is a high-risk prisoner?
(i) being mentally or emotionally disturbed or having a developmental disability, but not to the extent that medical intervention is required;
(ii) being suicidal;
(iii) being an escape risk;
(iv) having excited delirium;
(v) requiring prescription medication; or
(vi) being impaired by drugs and/or alcohol to the extent that he/she represents a danger to him or herself or another person.
What is the definition of a Phase 1 Youth?
a Young Person as de ned in the Youth Criminal Justice Act who is 12 years of age up to and including 15 years of
age.
What is the definition of a Phase 2 Youth?
means a Young Person as de ned in the Youth Criminal Justice Act who is 16 years of age or 17 years of age.
What is the responsibilities of the Police Constable when parading a prisoner to the Staff Sgt?
of the reason for arrest and continued detention;
if the prisoner has been searched and the results;
if the prisoner has received rights to counsel;
if the prisoner has injuries;
if the prisoner has a communicable disease;
if the prisoner is suffering from any medical condition;
if the prisoner requires prescription medication, and/or whether any have been administered;
if the prisoner is impaired due to alcohol and/or drugs to the extent that he/she represents a danger to him or herself or another person;
if the prisoner is potentially suicidal, violent or an escape risk; or
if the prisoner is emotionally disturbed or suffers from any mental illness or developmental disability but not to the extent that medical intervention is required.
What is the duty of the Staff Sgt when booking prisoners?
if possible, ensure the prisoners who are exposed to OC spray are decontaminated prior to being lodged in a holding cell;
ensure that whenever possible, two O fficers are in attendance in the cell area, at least one of whom is the same gender as the prisoner;
advise the prisoner that activity in the cell block is being videotaped;
ensure the prisoner is searched in accordance with Procedure LE-012 Search of Persons;
ensure the prisoner has been informed of the charges, their right to retain and instruct counsel without delay, and that they understand their rights pursuant to the Charter of Rights;
ensure the prisoner has been cautioned and issued the supplementary caution regarding any statements;
direct the prisoner to read the display poster displaying information on their rights to counsel;
provide the prisoner reasonable, private use of a telephone to speak with counsel;
in the case of young persons, provide the opportunity to speak with counsel, parent, guardian or other responsible adult;
view the prisoner and record any injury, illness, or complaint of injury, inquire as to the cause, and take the necessary action including obtaining medical attention where applicable;
identify high risk prisoners (refer to Section J);
record whether the prisoner is suffering from any known medical condition or requires medications, and/or whether any have been administered;
seize all personal property, such as belts, ties, shoelaces or any article that a prisoner may use to facilitate escape, in ict self-harm or harm to others or cause damage to police property. Such property shall be removed and stored securely prior to the prisoner being placed in a cell;
not seize a prisoner’s bra prior to placing the prisoner in a cell unless:
the bra’s under-wiring is exposed or easily removable from its casing;
the Officer in Charge has reasonable grounds to believe that the accused may use the wiring to inflict self-harm or harm to others;
the prisoner is known or suspected of being suicidal or violent;
o) only seize undergarments such as bras in accordance with the Strip Search procedure in Procedure LE-012 Search of Persons, Section E;
(p) ensure property is seized in accordance with Procedure LE-020 Collection and Preservation of Property and Evidence;
(q) enter the prisoner booking information within the Versadex Arrest/Booking maintenance subsystem, including the completion of the Detention Record (DR) template. The YRP274 Prisoner Booking/Transport form will be used only in the case of system failure or other special circumstances;
(r) note any hazard flags on the prisoners booking screen in Versadex; and
(s) complete a cell inspection prior to lodging the prisoner in a cell.
Providing medication
What is the exception for prisoners having their medication?
Nitroglycerine which prisoners are permitted to keep on their person in an amount not in excess of their prescription while they are in the holding cell and pledged separately from other prisoners.
What is a duty of Patrol Sgt for prisoners?
(a) periodically visit any offi cer(s) guarding the prisoner, regardless of whether they are on duty or paid duty o fficers;
(b) ensure that an Investigative Activity (IA) is added to the GO report noting the time(s) of the visit(s); and
(c) where required, notify the on-call SIU Liaison O cer immediately.
What are the duties for members in the event a prisoner dies on there watch?
(a) immediately notify their Supervisor;
(b) in absence of a supervisor, notify the Duty Inspector; (c) secure the scene; and
(d) document all particulars in their notebook
Whar are the duties for a patrol sgt in the event they are notified of a prisoners death?
(a) take charge of the scene;
(b) if the death occurs outside of York Region, have Communications dispatch the closest Supervisor to attend and take charge of the scene;
(c) notify the Homicide Bureau;
(d) notify the Forensic Identi cation Unit; and
(e) ensure the RTOC is noti ed.
Prisoner’s who require medication
Prisoners who have a requirement to use cannabis for medical purposes shall be placed under a doctor’s care at a hospital for treatment. Under no circumstances shall a prisoner be permitted to use cannabis for medical purposes while at a York Regional Police facility.
- Prisoners requiring medication shall only be given the medication if:
(a) there is only one type of pill in the prescription medication container and the label and contents do not appear to have been tampered with;
(b) the prisoner does not appear to be under the influence of drugs and/or alcohol. - All medication shall be self-administered by the prisoner, who will only be allowed access to the amount of medication listed on the prescription for a single dose.
- If approved by the Officer-in-Charge, prisoners requiring medication administered by injection (i.e. insulin for diabetes) shall administer the medication without any assistance. However, the prisoner shall be placed alone in a separate cell and closely monitored when administering the medication.
- Prisoners taking prescription medication shall be allowed water and/or food as appropriate to the prescription, to assist in the process of taking the medication.
- The details of any medication taken by a prisoner including time and dosage shall be documented in the Officer’s notebook and entered into Versadex RMS.
What is the Staff Sgt job for medication?
(a) retain control of prescription medicine at all times;
(b) ensure the medication is made available to prisoners in custody who require such medication, with the exception of cannabis which has been prescribed for medical purposes which shall be administered at a hospital without exception;
(c) ensure that the prisoner is taken to the hospital for treatment in any case where:
(i) there is doubt about the medication, dosage or legitimacy of a request for prescription medication;
(ii) the prescription is for marihuana; or
(iii) a prisoner is required to take medication for a condition capable of causing serious harm to the prisoner (e.g. insulin for diabetes or medication for a heart condition) but is under the influence of drugs and/or alcohol; and
(d) verify to their satisfaction that the prescription medication has been taken and not kept in any way for future use by the prisoner.
What are duties for processiong prisoners (booking prisoners in)
(a) where a preferred name is indicated which is other than their legal name, enter such name as an alias in all information systems;
(b) enter their self-identi ed gender with a note that they are a transgender person;
(c) ensure that the preferred pronoun is utilized (i.e. he or she) when referring to the prisoner;
(d) perform CPIC and any other queries using both birth-assigned and self-identi fied names and genders to ensure that no outstanding charges or warrants are missed;
(e) when determining housing at District or Court House cells, ensure it corresponds with the prisoner’s self-identi fied gender unless they indicate a preference to be housed otherwise;
(f) transport in accordance with Section X of this Procedure;
(g) ensure a Ministry New Admission Information form is completed, providing the requested information and that the form accompanies the prisoner to any facility where they will be held; and
(h) provide advance notice to escorting agencies of the presence of a transgender prisoner and provide the preferred name and pronoun.
