Describe processes used for law making
(Government)
Government processes - the majority of law is made in Parliament
- House of Lords - make and shape laws
- House of Commons - debate political issues and propose new laws
The Creation of a new law:
1) Green Paper - public consultation
2) White Paper - formal proposal
3) First Reading - the main aims of the bill are read out, formal vote is taken
4) Second Reading - main debate takes place, followed by another vote
5) Committee stage - group of representatives suggest amendments
6) Report Stage - amendments are voted on
7) Third Reading - Final Vote is taken
8) Royal Assent - Monarch Signs the bill
Descibe processes used for law making
(Judiciary)
Judicial Precedent - when a case appears before them, they must make a judgment which forms the law
E.G: Donoghue v Stephenson
Founded the modern day law of negligence and was decided by a judicial precedent
Statutory Interpretation - a judge in the superior court interpret words within a written law
E.G: Whitney v Chappel
“It wasn’t fraud as a dead man can’t vote”
