Proving intent - circumstantial
The offenders actions and words, before during and after
The surrounding circumstances
The nature of the act itself
Confine
Confining a person can include restricting their movements to within a geographical area, can also include curtailing their activity and exercising control and influence over them
Imprison
means to put them in a prison or to confine them as if a in prison. Can include locked in a room or the boot of a car.
Young person - Section 210
In this section young person means a person under the age of 16 years
Consent no defence
a person under the age of 16 years cannot consent to being taken away or detained
Belief that person was over 16 no defence
it is immaterial whether the offender believes the young person to be of or over the age of 16
