8.4 Crime And Punishment Flashcards
Why must laws be fair?
If one law is unjust it won’t be followed. If people think the speed limit was too high, everyone would be speeding and the police would be wasting their time.
If one law is unjust, many more will also been seen in that way. If this happens they don’t follow their purpose to protect the weak etc etc.
If a law is unjust it won’t be followed and people will campaign against it. In the 60s black people campaigned to get the vote and this caused lots of disruption in life.
If laws don’t create just society’s, people will revolt against an in just government. The kosovars had a war against Serbia as they didn’t think the legal system treated them fairly and this resulted in an independent state.
What are laws needed?
They protect the weak from the strong. They stop murder, rape and theft.
They insure people can take part in business and work. It wouldn’t be fair if people worked hard or sold tongs but weren’t duly payed. They mean people have to work.
They let you know how others will act, meaning it is easier to work together. Without them, people would drive on different sides of the road and at different speeds meaning accidents.
To make people agree with different things. Of there were two people and they didn’t know if they should do something, like euthanasia, the law would tell them what to do.
All religious people should fight for justice in the world.
Give reasons against.
Christians believe in the golden rule and no-one wants to be fought.
Muslims believe in in Jihads which are internal struggles for peace. Fighting will mean this can’t happen.
There are peaceful ways to achieve Justice. You can campaign for it or vote for a political party that aims for it.
All religious people should fight for justice in the world.
Give reasons for.
Christians believe that all people are created equally as we are all made in the image of God meaning we all deserve justice.
Jesus was the Christian role model and he was just. He treated everyone the same regardless of background so we should the same view on justice.
The parable of the sheep and goats. It says that we must treat others justly if we want to get to heaven so we should always aim for justice.
Why is justice important to Christians?
The golden rule. We all want to be treated with justice so we must treat others with justice.
We are all made in the image of God meaning we are all equal. Tis means we all deserve justice.
Jesus was just. He treated everyone the same regardless of background and so he is the Christian role model Christians should try and be like him.
The parable of the sheep and goats. This dais we must treat others with justice by giving them food and shelter. If we do this we get to heaven.
God is just. “There is no God but me, a just God and a saviour” Isaiah 45:21.
“Blessed are those who thirst for righteousness” Matthew 5:6
Famous Christians were just. Mother Teresa was fair to lepores and she says it was inspired by her faith.
The CCC says so and the RCC agreed to it with many other religions on the Jubilee 2000 agreement.
How can a Christian put their ideas on justice into practise?
Work in a charity that aims for justice like CAFOD.
Buy fair trade products. They insure that those in the developing world get a fair price for their produce.
Vote for political parties that aim for justice in the world.
Support human rights
Why is justice important to Muslims?
Allah is known as the Al-Adl which means the just. If Allah is just we should try and be like him.
“Believers conduct your self with justice and bear true witness before Allah” it comes from the Quran and it is the world of Allah so it should be followed.
The Ummah. It is a community of Muslims and members treat each other like brothers and sisters. As you would treat a brother with justice you should be it with everyone else.
The 4th pillar. Zakah. (Give 2.5% of income to charity) it is a pillar so it must be followed. Giving to charity means everyone is treated equally meaning justice.
Shari’ah law. It says that people should be just and it gives punishments for those who break the, so it is very important.
What is a nemonic used to remember the purpose of punishments ?
R e from. Really Random People Don't Remeber. R eparation P rotection D eterance R etribution
Explain reform.
Try and change the criminal so they don’t break laws again. Give them an education in prison. GCSEs and other qualifications will let them get a proper job so they don’t depend on crime. Send them to drug rehabilitation.
Explain protection.
Protect the public from the criminals. Prison protects us from the criminals. Capital punishment does this as well. The dead can’t threaten society.
Explain deterrence.
Put people off from committing a crime. They are very effective as they stop crimes in the first place. They have to be sever enough to do this. Death penalty, hand cut off.
Ban from driving when drink driving.
Explain Retribution.
Make the criminal pay for their damage, community service for vandalism, capital punishment for murder. It has to be proportional to the crime and make the criminal suffer in the way the victim did.
Reasons for the capital punishment.
If you kill a person, death is a proportional punishment.
It will deter other criminals.
It will give solace to the family of the victim.
It will protect society.
When it is given out the criminal has lots of trials and apples to insure an innocent man isn’t killed.
Reasons against capital punishment.
It could be the wrong man.
Sometimes the person wants death e.f. Ian Bradie. You are doing them a favour.
Some of the methods are inhuman e.g. Stoning.
Hypocritical. If it is wrong to kill a person, capital punishment is wrong.
Human right to life.
Terrorists are tuned into martyrs.
Give Christian reasons for capital punishment.
The bible sets down capital punishment for many different crimes.
The RCC and the C of E haven’t retracted their statements permitting capital punishment.
Thomas Aquinas said punishment should reform sinners but bringing peace to society is more important meaning capital punishment should be used to produce peace.
