6.10 General:

B. DEFINITIONS

  1. The term “Chief Administrative Judge” shall mean the Chief Administrative Judge of the courts or designee. **

6.20 Carrying of Firearms on Duty:

  1. Except as provided in Section 6.90(3), the purchase and carrying of a firearm on duty is MANDATORY for all court officers unless prohibited by the Chief Administrative Judge and/or Deputy Chief Administrative Judge.

A court officer who is required to carry a firearm while on duty may only carry a firearm as set forth in Section 6.40.

6.30 Carrying of Firearms Off Duty:

  1. When off-duty, there are certain occasions when a court officer should be
    unarmed, at their own discretion:

a. when the carrying of a firearm would unnecessarily create a risk of loss or then of the firearm, i.e. participating in sporting activities, attendance at beach or pool etc. or

b. while on vacation, or

c. when engaged in authorized off-duty employment, or

d. when there is any possibility that an officer may become unfit for duty due to the consumption of intoxicants, or

e. when involved in any activity where it would be advisable not to carry a firearm.

6.30 Carrying of Firearms Off Duty: (Cont.)

  1. A court officer who owns or possesses a handgun other than the firearm(s) as defined in Section 6.40, may carry those weapons only during private range practice or competitive shooting matches, or while hunting pursuant to a valid hunting license. When going to or coming from these activities, the weapon(s) shall be transported unloaded and in a locked box or gun case.
  2. A CO who appears in court in OTHER THAN an OFFICIAL capacity is PROHIBITED from bringing firearms into the court. **

6.40 The Firearm:

  1. The Service Firearm:

a. The service firearm for court officers shall be the Glock 19, 9mm Semi
Automatic pistol with the New York + (plus) trigger. **

b. The service firearm for court officers who have not successfully completed training on the 9mm pistol shall be a double action .38 caliber revolver, with blued, parkerized, nickel-plated or stainless steel finish and standard checkered HARDWOOD FACTORY GRIPS, and shall be
limited to one of the following: ** Smith and Wesson, Colt, Dan Wesson or Ruger. **

  1. The Off-Duty Firearm:

a. Glock 19 or 26, 9mm semi-automatic pistol with the New York + (plus) trigger.

b. The off-duty firearm for court officers who carry a revolver as a service firearm shall be a revolver with the specifications set forth in paragraphs 6.40 (1) (b) and 6.40 (3) (a) except that it may have a barrel length from two to four inches and a cylinder capacity of five or six rounds. **

  1. The internal working parts of any firearm MAY NOT be modified or altered in any way. **

a. For revolvers, the addition of a custom hardwood or hard rubber grip, grip adapter, or target hammer or trigger is acceptable. TRIGGER SHOES are NOT permitted.🚨(Quiz)

b. For the Glock 19mm pistol, no external modifications are permissible, EXCEPT night sights. **

  1. Court officers who believe that their firearm is damaged or defective in any
    way shall immediately contact the appropriate TRAINING OFFICER training officer employed by the Unified Court System, who will arrange for inspection and test firing of the weapon, if necessary.

6.50 Ammunition:

  1. Carry ammunition for the service revolver and the off-duty REVOLVER shall be restricted to the:
  • .38 caliber 158 grain
  • semiwad cutter, lead bullet. **

  1. All firearms SHALL be fully loaded when carried. The Glock 19 pistol chamber SHALL be charged.
  2. A court officer who is authorized to carry the Glock 19 when on duty + in “Class B” uniform SHALL carry two fully loaded magazines covered magazine pouch.

When in the “Class A” uniform and using a
holster on the uniform belt, SHALL carry a minimum of one magazine + no more than two magazines of extra ammunition.

“Class A” same when on duty in CIVILIAN CLOTHES, carrying Glock 19 or Glock 26. **

FIREARM HOLSTER: Directive 1a - 2014

  1. In addition for the Glock 19 pistol, presently employed Court Officers are authorized to carry the Safariland ALS Model 6360 mid-ride or 6365 1.5” drop Level III Retention holster. **
  2. As of this directive’s effective date, newly employed CO Trainees MUST qualify and carry the Safariland ALS Model 6360 Level III Retention holster until successful completion of the 2 year training period AFTERWARDS, ** they have option to carry the Safariland ALS Model 6365 Level III Retention holster. **

6.60 Holsters

  1. Court officers who are authorized to carry a firearm on duty shall carry the on duty firearm in one of the following ways:

a. Blouse: on the uniform belt in a holster SHALL have a COVERED trigger guard, a SNAP type closure + good condition, or having a safety rating of LEVEL 2.

REVOLVER: on a gunbelt, security plus holster Level 2 or a Safariland: SSIII Retention Level 3 holster.

GLOCK 19, 9mm pistol: on a Sam Brown or River Belt type gunbelt with a minimum of 4 velcro or snap keepers, in the Safariland SS III Model 070 or 0705, or Gould and Goodrich Galaxy Model B741-G19 holsters.

6.65 Firearms Training:

  1. A court officer shall successfully complete the basic firearms certification
    course and all annual requalification courses, as prescribed by the Chief Administrative Judge, to be or remain qualified to possess and carry firearms.

  1. A court officer shall be issued a “no gun” identification card on the first day of employment in a court officer title. No court officer may purchase, possess, acquire or carry a firearm until he/she has been issued a regular court officer identification card without the “no gun” restriction. **

  1. CO eligible to begin training in the use of a firearm within SIX months of satisfactory service unless this requirement is waived by the Chief Administrative Judge. **

6.70 Registration and Inspection:

  1. All firearms owned, possessed, or acquired SHALL be registered with a supervisor by presenting a legible copy of the bill of sale or record of transfer.
  2. and CO SHALL report acquisition or disposition on NYS Police Form C.
    (Acquisition or Disposition of a Firearm by police officers and peace officers)
  • Form C shall be submitted to their supervisor, who shall submit, ASAP, the original to the Division of Court Operations, Court Security Unit for endorsement and forwarding to the New York State Police.
    No C Form shall be submitted directly to the State Police by an individual officer.
  • NO LATER than the next regular business day following the day of acquisition for both 1. and 2. **

6.70 Registration and Inspection: (Cont.)

  1. Any firearm owned or possessed by CO that is sold, lost, stolen, transferred or destroyed, shall be reported by CO in writing to their supervisor no later than the next regular business day. **
  • and reported to the Police Department of the jurisdiction in which it occured. If the firearm is under the control of a supervisor, the supervisor shall immediately notify the Police Department of the jurisdiction in which it occured.

The supervisor shall immediately notify the Inspector General, in writing, of any firearm that is reported lost, stolen or destroyed.

6.80 Safeguarding:

  1. A court officer who discharges a firearm, whether on or off duty, except during target practice at a pistol range, shall report such discharge immediately to the Police Department of the jurisdiction where the discharge occurred. **

6.91 Penalties / Loss of Peace Officer Equipment: 🚨

  1. The schedule of penalties for loss of firearms, shields or peace officer
    identification cards shall be as follows:

a. FIRST OFFENSE 🚨

Loss of Firearm:
Forfeiture of up to 10 days annual leave, six months firearms suspension, Classroom retraining.

Loss of Shield:
Forfeiture of up to 5 days of annual leave.

Loss of Identification Card:
Forfeiture of up to 2 days annual leave.

b. SECOND OFFENSE Within 5 years of first offense: 🚨

c. THIRD OFFENSE
Within 7 1/2 years of first offense:

  1. Where more than one type of property is lost in a single incident, the penalty imposed may be cumulative. **

6.92 Domestic Violence-Related Offenses and/or Order of Protection:

  1. In addition to complying with relevant New York State and Federal Law, court officers and peace officers who are arrested for a domestic violence-related
    offense and/or served with a temporary or permanent order of protection
    must:

b. File an Unusual Occurrence Report (UF-101), and surrender all firearms owned or possessed by the court officer or peace officer to the appropriate supervisor before the conclusion of their next tour of duty.

c. Surrender their ID card to the appropriate supervisor as soon as possible; a “no gun” ID card will be issued.

6.92 Domestic Violence-Related Offenses and/or Order of Protection: (Cont.)

  1. When there is an arrest of a court officer or peace officer for a domestic violence-related offense, the appropriate supervisor shall immediately notify the Inspector General, in writing.
